The state has been seeking sworn testimony from Eric Trump for months as part of a probe of asset valuations at the Trump Organization, where he’s an executive vice president. After New York took legal action in August to enforce a slate of subpoenas, Trump’s lawyer said his client had simply adjourned the deposition to get “certain assurances first.”

“This assertion is false,” New York Attorney General Letitia James said in a court filing Tuesday night in Manhattan. Trump gave his “categorical refusal to appear” through a July 27 letter from his lawyer, she said.

Interesting side-issue.

Eric is following his father's game plan. Drag it out as long as possible is the first step. In the meantime, we'll see if Barr and the DOJ jump in to defend another corrupt Trump associate (in this case, his son).
This was probably a good legal tactic when the trump organization was being sued by a contractor for non-payment for services rendered or goods purchased (trump has had thousands of these lawsuits against him), where the big company trump organization can just outlast the small company contractors who can't afford years worth of legal expenses, but I doubt that it's going to work for trump in the long run in a legal battle with the State of NEW York (or SDNY).

It very well may if he wins a second term and has a corrupt DOJ acting on his behalf.

A judge in New York on Friday ordered a law firm serving as counsel to the Trump Organization to turn over documents related to the former president's business to the state's attorney general.

New York State Supreme Court Judge Arthur Engoron said in an order that he had completed a review of documents from the firm Morgan, Lewis & Bockius and determined that at least some of them were not privileged and should be handed over to the attorney general's office, which had subpoenaed the firm and the Trump Organization.

New York Attorney General Letitia James (D) is investigating whether former President Trump's company had falsified the value of certain assets in order to secure loans, tax breaks and investors.

Thanks for the update.

It looks like these investigations can finally continue without unethical interference from the federal government. It's wild, seeing how many conservatives support such blatant corruption, but are now talking about "teh left" being corrupt and overstepping its authority.

The New York attorney general's office says it is investigating the Trump Organization "in a criminal capacity".

A spokesman for the state's top prosecutor, Letitia James, said the inquiry into Mr Trump's property company was "no longer purely civil".

Ms James' spokesman, Fabien Levy, told the BBC on Tuesday: "We have informed the Trump Organization that our investigation into the Organization is no longer purely civil in nature.

"We are now actively investigating the Trump Organization in a criminal capacity, along with the Manhattan DA. We have no additional comment."

Ms James launched a civil inquiry in March 2019 into claims that Mr Trump had inflated the value of his assets to banks when seeking loans, and understated them to lower his taxes.

Her office has also been seeking documents on four Trump Organization properties in Manhattan, upstate New York, Chicago and Los Angeles.

Manhattan District Attorney Cyrus Vance Jr said in court documents last August that his office was investigating alleged "protracted criminal conduct" at the Trump Organization.

Let's not jump to conclusions about guilt here - innocent until proven guilty and all that. I am sure the Trump organisation will be keen to clear this allegation of 'protracted criminal conduct' once and for all and therefore make every effort to expedite an early trial.

If Trump wants to be on the 2024 campaign trail stumping for himself or someone else he’ll want the trial behind him. If he is willing to just sit and make proclamations and kings from his desk he can let it drag out. If he is making speeches off the cuff he could accidentally give the prosecution more evidence against him (and with his tendency to spin into lamenting how he has been wronged, it’s likely). He’s going to have to represent himself in court or pay an attorney significant money up front because no attorney worth his salt is going to take this case when his client is risking self-incrimination multiple times a week.

Only the guilty want to delay justice. I expect the Trump organisaton to leap into the fray, the sword and shield of justice and liberty held high.

It would be a dreadful slur on the reputation of the President Emeritus for this case to 'drag on'. He would not let it happen, surely?

From the link:

Trump attorney Alan Garten didn’t immediately respond to a message seeking comment. He previously called the legal action a “discovery dispute” that James had amplified for political advantage.
I agree - NY State embraced and worked hand in hand with Trump for decades until he became President.

Do you think the prosecution should not go ahead? Even if there is evidence of wrong-doing? If there is nothing to this case it will be easy to defend.

His MO is to drag things through the courts for years and years.

That is NOT how Donald Trump roles. He almost always "settles out of court" to avoid admitting guilt. It was how he solved the discriminatory housing charges back in the 70's he and his daddy were hit with, it is how he solved the Trump University Fraud cases.

There will be no "trial" and a settlement will occur and Trump will somehow remain outside of a jail cell.
