I love how he neglected to mention that he was paying said professor $1350/hr to work for him on this case. It kind of makes his testimony suspect.

Ehhhh, yes and no.

There are plenty of experts that testify in court that get reimbursed for their time. An old boss was a recognised expert on groundwater contamination. Even after he retired, he still consulted on cases, wrote reports and was an expert witness for various parties.

I will agree that things gets shady when lawyers start paying experts far in excess of their typical earnings. If you're a consultant getting ~$125 an hour for independent work, it's more than a bit suspicious if your rate for a court case is $500 an hour.

While it's hard to track down what someone may or may not have heard on Newsmax, here's some context.

Please try to keep your mind on the crux of the matter. It is not whether the bank was repaid; it is not whether the bank was happy. It is whether the bank was defrauded (and in particular whether any bank employee claimed it was not).

Trump defense points to bankers as proof business dealings had ‘no victim’


“I would point out that the mere fact that the lenders were happy doesn’t mean that the statute wasn’t violated, doesn’t mean that the other statutes weren’t violated,” Judge Arthur Engoron said, taking the request [to dismiss the case] under advisement.

Throughout the trial, Trump’s attorneys have attempted to show that banks were eager to work with the Trump Organization and excited by the outcomes of their partnerships — that there was “no victim” of the business’s real estate dealings, implying the New York attorney general had no right to bring the case because the banks did not sue him over misrepresentations.

Nicholas Haigh, Deutsche Bank’s former risk management officer, previously testified in the New York attorney general’s case that Trump’s statements of financial condition played a vital role in the approval of two of those loans

Trump was able to secure bigger loans with lower interest rates thanks to the documents, Haigh said.

Judge rejects key points of Trump’s defense in NY civil fraud case in bad sign for former president

It would be a “glaring flaw” to assume testimony from Trump accounting experts Eli Bartov and Jason Flemmons are true and accurate, the judge wrote.

The case record proves there are many material misstatements on Trump’s personal financial statements, according to Engoron.

“Bartov is a tenured professor, but all that his testimony proves is that for a million or so dollars, some experts will say whatever you want them to say,” Engoron wrote. “By doggedly attempting to justify every misstatement, Professor Bartov lost all credibility.”

“If you pay a lower interest rate on a loan by overstating the value of any of your assets, thus lowering the perceived risk to the lender, your gains are ill-gotten,” Engoron said. “That the instant lenders made millions of dollars and were happy with the transactions does not mean that they were not damaged by lending at lower interest rates than they otherwise would have.”

Last week, Greenfield cleared the biggest hurdle to the Manhattan civil judgeship, when local Democratic Party leaders rated her "most highly qualified."

The next big step happens on Monday. That's when Democratic district leaders are expected to nominate Greenfield as the unopposed Democratic candidate for the judgeship on the November ballot.

Democratic candidates for judgeships often run unopposed in this city of few Republicans.

[Trump's lawyer Alina] Habba, in particular, has singled her out, complaining to the judge on a trial date in October about "the treatment that I've received from Ms. Greenfield from the bench."

"It is inappropriate," Habba said, facing both Engoron and Greenfield, who she said had rolled her eyes during her cross-examination of Michael Cohen.

"I do not like having eyes rolled," Habba said. "I do not like being yelled at by law clerks who did not earn the robe, and I think this is completely inappropriate."
