According to the online NIV @ Bible gateway, the word Spirit is capitalized. Your interpretation is wrong the verse does not say "
God knows our spirit by what is in our hearts and minds." It says "
He (God) ... knows the mind of the Spirit, because [not when] the Spirit intercedes for Gods people in accordance with the will of God." This verse as written, not as you have tried to rewrite it, says that the Spirit has a mind.
