There's just a few differences between the cases, the racist was more than happy to brag about what he had done:

Wouldn't it have been smarter to post about them trying to get him expelled before invoking the crickets?
He shouldn't be expelled for something he didn't do on campus I have serious doubt there's something in the student handbook about being a snarky racist to people who aren't on your campus.
