Vindman’s Lawyer Asks Fox News to Retract Espionage Allegation

Laura Ingraham was interviewing former Bush adviser John Yoo, of Torture Memos fame. Ms. Ingraham insinuated that Vindman worked against Donald's interests, to which Mr. Yoo replied, “I found that astounding. Some people might call that espionage.”

A guest on the ‘Ingraham Angle,’ a Fox show, suggested that Lt. Col. Alexander S. Vindman, a key figure in the impeachment hearings, was guilty of spying.

...Colonel Vindman was not trying to silence the news media, Mr. Pressman wrote. “He wants, as any responsible news organization would want, to see the truth published,” he said. “And Fox News is in a unique position to correct its falsehoods with truth.”

The segment “sparked a torrent of republications and copycat false charges,” he added.

Fox claims that Yoo alone is responsible for propagating that view. Maybe Yoo will go with Donald's favorite device, that he didn't say it, but vague, unknown, unnamed folk did.

He sent the letter to the wrong people. FOX did not make any allegation. He needs to demand a retraction from the person that made the statement "Some people might call that espionage ". That is not even an allegation it is a piece of speculation on what someone might say. There are smaller, less influential publications , blogs etc. that have made accusations. He ought to be sending them letters demanding retractions not FOX which made no such accusation.

On Monday, Fox News quickly began suggesting that Vindman may be some sort of double-agent for Ukraine. The basis for such an outrageous theory, according to Laura Ingraham, is the fact that Ukrainian officials “sought advice” from him about how to deal with demands from Rudy Giuliani, the president’s personal lawyer—a detail Ingraham suggested that the New York Times conveniently “buried” in its report on Vindman’s opening statement.

At no point during the Segment did Fox News publish any facts that could reasonably
provide a basis for accusing LTC Vindman of criminal -- treasonous-- misconduct. The viewer was left to understand that Ms. Ingraham, an attorney and former Supreme Court clerk, and her law professor guest must have had a factual basis for concluding that LTC Vindman had engaged in espionage against the country he has sworn to protect. They did not.​

Alan Dershowitz, who was also on the segment, didn't pipe up until the next day (after he looked up who Vindman is) that the statements were false and defamatory.

...That same day, an Assistant to the President of the United States tweeted from his official White House account, "ICYMI: Lt. Col. Vindman was offered the position of Defense Minister for the Ukrainian Government THREE times! #ImpeachmentSHAM." The President himself retweeted Mr. Scavino's tweet to his 66.9 million followers....

Until Fox News published the Segment, Vindman had never been accused of disloyalty, dual loyalties, or espionage against the United States. There was no factual basis for Fox News' accusation.

There appears to be no dispute that Fox News lacked any factual basis for publishing the false and defamatory Allegations concerning LTC Vindman.​

Letter says that Vindman didn't come into the public eye because of his actions. That's incorrect.
Is it a fact that "FOX news reported "breaking news" that LTC Vindman committed the crime of espionage against the United States on behalf of Ukraine"? I watched the segment included in the Twitter from Andrew Lawrence. Either I missed something or that was not there.If FOX news reported that as "breaking news" as the lawyers contend, then I would like to know when and where that happened. Fox then would need to retract it and apologize . If the lawyers for Vindman are claiming that YOO talking about Vindman's testimony to Congress being called "breaking news" when he doesn't see it as of much importance is FOX news reporting as they have claimed then it is the lawyers that are slandering FOX and need to retract their statement.
