I have often thought that the world won't impose a punishment on others that it wouldn't want imposed on itself. Even to save itself.

1. In innocent spouse or family member would still need access to the car.
2. Even without said family members, the person would still need the car if they could secure a willing & qualified driver. (You want them to get to their addiction counseling appointments, don't you...?)

There are several other ways to get places. The family would likely save money as well by using them.

But the co-owners of the car aren't guilty of anything. My wife co-owns our car, but cannot drive due to poor eyesight.

And the law doesn't take away one's right to own a car (in other capacities), just the privilege of driving one.

If their (own) business owns a fleet of cars available to their employees, do those get confiscated, too?

I get the sense that you don't think that drunk driving is a very big problem. Based on the present laws you are in good company.

Well, your "spider" sense isn't working correctly. There are laws on the books that limit the liability of an innocent spouse in the guilty spouse's gambling debts. There is no easy fix.

Limiting liability doesn't mean limiting the consequences.

That depends on if the owner knew the subject was a drunk driver under suspension. Borrowing another's vehicle to thwart the law is serious and must be addressed. Having a friend 'blow clean' into a breathalyzer ignition interlock is also a problem.

I think 10,000 deaths and many thousands more injured each year is cause for concern that our present laws aren't effective enough.

The premise of the OP is if driving privileges are revoked, one's car should be impounded. What should be done if the first car was borrowed?

It's not my purpose to address every situation, just the most egregious ones. Present laws are wholly inadequate. It is ironic that the State can confiscate your vehicle if used in the violation of big game hunting laws but allows drunk drivers free use of them.

If you want to build a scenario, why did the subject borrow another's car in the first place? Did he crash his own while drunk?
