No. They're just refusing to go beyond legal requirements for the convenience of the feds. Frequently, that means not holding a person illegally (by state law) when the feds fail to get there in time to make the pickup.
I've never heard of that happening, as plausible as it sounds.

Notice that nobody is talking about criminal prosecutions....

I've never heard of that happening, as plausible as it sounds.
It's actually pretty common. There are even conservative jurisdictions who are following that policy because the federal government doesn't reimburse for the additional time that they are holding somebody just so ICE can pick them up.

Apparently that additional time can go into months.

Well there are places that refuse to hold illegals. I don't think there is a law that says a county or city MUST hold illegals. There should be. If a person who is arrested is found to be an illegal the city or county should be required to hold them until the person is deported.
Either that or the federal government gets completely out of requiring states to do anything.
