The department "has been actively reviewing video and other open source materials of some USCP officers and officials that appear to be in violation of Department regulations and policies," she said on Jan. 11.

Videos from the day of the attack appear to show some officers escorting rioters inside the building. In one video, USCP officers can be seen opening barricades allowing the mob to enter the Capitol complex without resistance.

If you would have researched anything on this story, Biden AND Pence immediately returned anything in their possession. If Trump had done the same he wouldn't be in the mess he is in.

First, there are only two cases against Trump being brought by the DOJ, Jan 6th and classified documents. Both are run by the special counsel precisely to keep the President and his political appointees out of the decision tree.
Jack Smith was appointed by Merrick Garland, who was chosen to be US Attorney General by Joe Biden
The classified documents case started when the National Archives contacted him for missing classified documents. He didn't return them and actively obstructed the search. So he was indicted for retention of classified documents and obstruction of justice.

I think the DOJ and state level proesecutors are holding Donald Trump accountable for his actions after the 2020 elections. My opinion is backed by 91 Federal indictments. I really don't care what effect these prosecutions have on Donald Trump. It's his choice to run as an indicted candidate. It's the voters choice to reject him.

No I don't, because DoJ policy has for decades forbade charging the President with a crime. Doesn't mean that what he finds can't be used in impeachment or prosecutions after Joe leaves office. And he will be required to issue a report about what he found and explaining his charging decisions.

When Rod Rossenstein hired Robert Mueller to investigate whether members of the Trump 2016 presidential campaign had colluded with the Russians to illegally interfere in the 2016 presidential election, they put restrictions onto Robert Mueller. They told him not to indict the sitting president. So it instead became an investigation into everyone on the campaign team other than Donald Trump.

With regards to the Special Council assigned by Garland to investigate Biden's documents, we don't know if this restriction has been placed on him.

The red part you highlighted *is* important, but the second clause is as well.

Willful retention and failure to deliver are the issues. There is no evidence that either Biden or Pence "willfully retained" any such document. From all available reporting (the ONLY information we have in the public) both Biden and Pence not only returned any such documents when realizing they had them, but invited the FBI to search. Trump did not.

Accidental retention is *not* a crime.
