Satanic Temple announces a Satanic Ritual Abortion

    "In accordance with the Religious Freedom Restoration Act (RFRA), first trimester abortions are now exempt from unnecessary regulations for all individuals practicing The Satanic Temple's religious abortion ritual."

    An interesting move by the Satanic Temple which counters the push from the fundagelicals on the right to ban abortion.

    This could mean that a woman who wants an abortion can claim "religious freedom" as the justification for getting one. I wonder how this would hold up in the courts.

    I do not think it would hold up when there is a law against abortion. It would be like human sacrifice as religious freedom.

    Given how important religious freedom is in this country, sounds like a terrific was to expand that right to more citizens. Maybe they could add a no-mask-no-service religious ritual so that business owners can kick out people who don't comply with public health initiatives.

    This law would have to include something that grants a fetus the same rights a living person has, which strikes me as very unrealistic.

    The facts are there if you want to know the truth. We even have laws that recognize that if the mother is assaulted resulting in the death of the baby the charge of murder can be invoked.

    As far as I understand it a fetus is only defined as a person in these cases for the purpose of criminal prosecution of the offender.

    But this goes a bit too far into criminal law which I am not very knowledgeable about.

    If an unborn child is a person under criminal law why would it not be a child under any other circumstances? The truth is obvious but it is inconvenient. unfortunately and unfairly the child suffers death for indiscretions of the parent.

    Yeah, and I am allowed to break my own windows, but if someone else breaks it then it's a criminal act. Context matters.

    well that is totally irrelevant. The only question is the question of what is a person. Only a fool would claim that an unborn child can be a person under one law and not be a person under another law. A person is a person that is not something that changes.

    Person as a legal definition definitely can change based on the context. Remember that words can have different meanings under different circumstances.

    So if tomorrow the court tells you that you are no longer a person, how exactly have you changed?

    Only a complete moron would deny that an act can be legal in certain conditions but illegal in others.

    Off the top of my head a fetus doesn’t count as a person in the census, on taxes, for welfare, building occupancy limits, and attendance at baseball games. There may be others.

    No change would take place other than that I don't fit the description of "person" under the law.

    There are laws requiring companies to provide health insurance that covers contraception, but religious companies don't have to obey them. That's the whole point of all this 'religious freedom' going around these days -- being able to ignore laws.
