The same way you do when a 40 year old man drops dead in the parking lot of a shopping center.

Yeah, they perform an autopsy. What sort of autopsy can be performed after a miscarriage? Especially considering the miscarried fetus is probably not around anymore

And if the autopsy doesn't reveal anything untoward, there is no police investigation.

The autopsy is part of the investigation. But you didn't answer my question; how do you perform an autopsy on a miscarried fetus? The fetus likely isn't around any more. So the mother needs to be investigated instead. Just like if there was a single mom who had a baby, and a few weeks later doesn't have that baby anymore. A neighbour reports it. The police will (hopefully) investigate why this recent mother doesn't have a child anymore.

Nobody has answered my question as to why miscarriages were not investigated back in the day when abortion was legal

Because back then, abortion was illegal (I assume that's what you meant) but the unborn were not considered citizens or persons. But under Rand Paul's proposal, they would be. And as such, they would be afforded the same rights and protections as all other persons, which includes investigation when they die under possibly negligent or malicious circumstances.

Exactly.

Why was abortion illegal

I dunno. But it's not because a fetus was considered a person with all the rights thereof. At least, not until "quickening", which is when the fetus started to move. Which is not until the end of the first trimester at best. Long after most abortions occur.

If you don't know why it was illegal how can you say it wasn't because the baby was considered a person?

Because a fetus wasn't considered a person.

(A baby was, but let's use accurate terms, shall we, to avoid confusion.)

Even today, you can be charged with murder for killing an unborn baby

How can you be convicted of murdering a non-person?

Because that's how the law is defined. It can be a person, but it's not a person with all the rights and privileges thereof. It has some of those rights, as decided by lawmakers, but not all of them.

You're describing a duplicity in the law. Rand's proposal corrects that
