Again, wishful thinking, but untrue. Gender discrimination is only illegal in certain very particular circumstances in the States. You can bar women from joining social clubs, from the draft, from the men's bathroom, from walking around topless even if they have no appreciable breast mass when men are allowed to waggle immense moobs in public, from hetero marriage at different ages than those allowed for men, from using the men's tee in a golf tournament, etc., etc.

This is a red herring. In adminstrating private contracts, the government cannot so discriminate.

I agree that it should be unconstitutional, but it isn't. There's nothing in the constitution that prohibits gender-based discrimination; the ERA never passed. We still have separate bathrooms, bans on same-sex marriage, social security-based draft requirements based solely on the presence of a penis, and people in the military who try to keep women from being fighter pilots.

Perhaps I should've been more specific. In this instance the equal protection clause of the 14th amendment covers it.

We're talking about a guy who thinks marriage is a liscence to beat your wife senseless, leaving her no recourse. I wouldn't worry to much about his logic.

Marriage is a private contract? Since when? Why then does only the State have the authority to grant a marriage licence?

So can piercing one's ears, getting tattoos, drinking alcohol, and going o war. The Bible has no problem with these, so I don't think "anal sex MAY result in an infection, therefore all homosexual sex is bad" follows. Not least because heterosexuals can have anal sex too.
