I think it's been made to big of deal. Yes, Smollett made a mistake. But shouldn't get anything . But a slap on the hand. Also I suspect the FBI has been looking into this case. And might give him a slap on the hand.

Except if it was a hoax, then no hate crime was committed, because the crime wouldn't have been motivated by Smollett belonging to a protected class.

How does one know if it was a hoax? An investigation would have to occur, correct? So, there is an alleged hate crime that falls under the federal law for which the Justice Department can investigate. If it was found to be a hoax, I don't know if there are federal charges that could be brought against him. But it sure would cause problems for the prosecutor who dropped the charges.
