I can always fall back on the other meaning of "should".
Certainly. Companies should face repercussions for fraud but until Elon falls out of favor his companies will be insulated from any ill and propped up in ways that will make us look back at the white house lawn car lot as quaint.

Tesla speeds up odometers to avoid warranty repairs, U.S. lawsuit claims

  • Tesla faces a proposed class action claiming it speeds up odometers on its electric vehicles so they fall out of warranty faster, saving Elon Musk’s company from having to pay for repairs.
The plaintiff Nyree Hinton alleged that Tesla odometer readings reflect energy consumption, driver behavior and “predictive algorithms” rather than actual mileage driven.

He said the odometer on the 2020 Model Y he bought in December 2022 with 36,772 miles on the clock ran at least 15% fast, based on his other vehicles and driving history, and for a while said he drove 72 miles a day when at most he drove 20.
I was reading about this. So far, it is only alleged, but it would not be surprising.

Musk increases the trade imbalance.

Sales of Tesla vehicles in 32 European countries tumbled 49% to 7,261 in April from 14,228 in the same month the previous year, according to the figures released by the European Automobile Manufacturers’ Association, or ACEA.

Electric cars were up 28%.

BYD thanks Elon as it outsells Tesla in Europe.

Tesla stock dips as second-quarter earnings reduce investor confidence

Tesla shares tumbled Thursday after its latest earning results knocked the wind out of investors’ confidence in Elon Musk’s electric vehicle maker.

The company has been facing intense competition, cooling consumer interest and a reduction of the government incentives that made buying EVs more affordable.

Tesla announced Wednesday that its automotive sales totaled $16.6 billion in the second quarter, a 16% drop from last year. Total revenues declined 12% from last year to $22.5 billion.

....and on the investor call, Musk admitted the long-awaited "Telsa Model 2" - promised as the affordable Tesla for years - is none other than a stripped down Model Y.

Clearly a sound foundation for a valuation of a trillion or so.

Any Tesla owners who want to ditch their otherwise working car, I can do that for a dollar. You pay me or I pay you, I don’t care. I am not offering to pick up your monthly payments though.

If you have Tesla stock, same offer, a dollar a share, you pay me or I pay you. But I have a limit of a few hundred shares so act fast.

More class action action

Elon Musk and Tesla suffered a pair of legal setbacks on Monday after federal judges in California and Maryland certified separate class action lawsuits against the carmaker and its CEO personally.

The rulings open the door for broader litigation over Tesla's marketing of its self-driving technology, and Musk's alleged role in efforts to defund the U.S. Agency for International Development (USAID).

In California, U.S. District Judge Rita F. Lin certified two classes in litigation over Tesla's claims that its vehicles were equipped for full self-driving capability. The case centers on statements by Tesla and Musk that all vehicles produced since late 2016 had the hardware necessary for "Level 5 Autonomy."

Judge Lin concluded that Tesla's representations were widespread enough to affect California purchasers and could form the basis for class-wide claims under consumer protection and fraud statutes. "Plaintiff has shown by a preponderance of the evidence that class members were exposed to the Hardware Statement from October 2016 to August 2024," she wrote.

[Maryland case is USAID employees as a class suing Musk for doing things only a confirmed officer of the US could do (like fire them all).]
