I would expect the Guard to be less likely to fire on unarmed civilians than the local police. Remember that for local police, "civilians" are the threat they've trained to combat or, at the very least, completely control. For the Guard, civilians are the people they've trained not to combat, and they have all been explicitly trained against repeating the Kent State incident.
Police are reluctant to shoot civilians too, especially unarmed ones but you're correct, the Guard would be even less likely

In 1970 the police could legally shoot an unarmed fleeing felon.

I don't know. I am not a scholar of protest or civil disobedience in the US. Measuring the effectiveness of protests is difficult.

There is one case I know of where a law was intentionally violated to challenge the law in court: the 1925 violation of the Tennessee anti-evolution law by John Scopes at the behest of the ACLU.
It was the primary mode of operation in the late 50s and into the early 60s.

Ever hear of the Freedom Riders? If not, Google...it's a dramatic tale of some incredibly courageous young people.

But here is the deeper question: Have you actually examined their strategy? Because when you assert, "There is one case I know of where a law was intentionally violated to challenge the law in court: the 1925 violation of the Tennessee anti-evolution law by John Scopes at the behest of the ACLU" it sounds like you haven't looked at the Civil Rights Era very closely.

I had already given you one particular case of intentionally violating a law in order to challenge it in court...and then you say you only know of one case...not that one. Well, you certainly know of two cases, because I just told you about another.

And now I've told you about yet another...a case that was replicated a hundred times.

But that was also the strategy behind every sit-in as well: To go past the sign that said "Whites Only" and take a seat, being very careful not to break any law except the segregation law...despite provocation.

The problem is that you asserted that civil disobedience is about getting arrested to change the law under which you were arrested:

You have to understand how civil disobedience works, though:

The people who practice civil disobedience accept arrest and then take the matter to court.

The courts determine whether the law they broke should be upheld.

Forcing the law to be proven in court is the point of civil disobedience.

But that clearly doesn't apply here, nor in many other cases when civil disobedience has been used. You don't think that anyone who blocks ICE at the Home Depot expects their arrest to challenge the deportation law, or any immigrant activist thinks that is a path to affecting change with immigration law and policy, do you?

I saw a movie one time and it showed law enforcement making an agreement with people who attacked the freedom riders to give them time to get away before they responded
