Giuliani is purportedly broke--and Trump calls him a loser who didn't win the election cases.

"In an unsparing, 57-page ruling, U.S. District Court Judge Beryl Howell said Giuliani had flagrantly violated her orders to preserve and produce relevant evidence to the election workers, Ruby Freeman and Shaye Moss, resulting in a “default” judgment against him. She also ordered him to pay Freeman and Moss “punitive” damages for failing to fulfill his obligations.

The ruling means the case will now proceed to a trial purely to determine the amount of damages Giuliani will have to pay the two election workers.


“Just as taking shortcuts to win an election carries risks — even potential criminal liability — bypassing the discovery process carries serious sanctions,” Howell wrote."



From the judge's decision:
"Rather than simply play by the rules designed to promote a discovery process necessary to reach a fair decision on the merits of plaintiffs’ claims, Giuliani has bemoaned plaintiffs’ efforts to secure his compliance as “punishment by process.” Id. at 75:12. Donning a cloak of victimization may play well on a public stage to certain audiences, but in a court of law this performance has served only to subvert the normal process of discovery in a straight-forward defamation case, with the concomitant necessity of repeated court intervention."

It is encouraging to see American laws actually working to benefit all Americans. These ladies were definitely defamed and smeared by the Trump coup participants. Life is so unfair to billionaires and sycophants who run out of gullible donor money to spend on their own legal defenses. They brewed a bitter tea after Trump lost the election and now they are forced to drink it. Good.

Maybe he's just got rich friends. Some Supreme Court justices manage to fly private despite not making enough money to pay for it themselves.

And as an experienced former prosecutor, he certainly knew what he was doing....as the judge alluded to in her ruling.

It will be interesting to see the damages the jury awards....

Last month, Howell ordered the former mayor to pay nearly $90,000 of the election workers’ legal expenses due to what she found was noncompliance with her earlier discovery orders. In her ruling Wednesday, the judge ordered Giuliani and his businesses to pay an additional roughly $43,000 due to the failures. Those sums are separate from any damages a jury may impose.

Judge punishes Rudy Giuliani for 'continued and flagrant disregard' of court orders

U.S. District Judge Beryl Howell said jurors at an upcoming trial will be told that the former Trump lawyer intentionally tried to hide financial documents.

In a five-page ruling, U.S. District Judge Beryl Howell said the move was necessary given "Giuliani’s continued and flagrant disregard of this Court’s August 30 Order that he produce financial-related documents concerning his personal and his businesses’ past and present assets" and other pertinent information.

Additionally, Giuliani and his lawyer will be prohibited "from making any argument, or introducing any evidence, stating or suggesting that he is insolvent, bankrupt, judgment proof, or otherwise unable to defend himself" since he failed to hand over evidence that would show that's true, the judge wrote.

In a filing last month, Freeman's attorneys said Giuliani “failed to take any of the actions” ordered by the court, including turning over $89,000 in legal fees.

Giuliani won’t testify in defamation trial, closing arguments underway

Despite his repeated statements that he expected to testify in his defamation damages trial, Giuliani’s defense passed on Thursday morning, moving the four-day-old trial to closing arguments after attorneys for plaintiffs Ruby Freeman and Wandrea ArShaye “Shaye” Moss rested their case.

Giuliani’s decision was not a surprise, since defendants very rarely risk testifying at trial. In Giuliani’s specific situation, he is already facing criminal indictment in a Georgia 2020 election case, and identified as an uncharged “Co-Conspirator 1” in Trump’s federal election obstruction case, meaning he could have had to repeatedly assert his 5th Amendment right against self-incrimination in cross-examination.
