The US Justice Department has filed a lawsuit against SpaceX, the Elon Musk-run rocket and spacecraft company with extensive government contracts, for allegedly discriminating against refugees in its hiring practices.


Elon was asked this 2016

Unfortunately, this is not up to us. U.S. government regulations make it hard to get a job in the U.S., but if you are working on rocket technology, that's considered advanced weapons technology.

So, even a normal work visa isn't sufficient unless you get special permission from the Secretary of Defense or the Secretary of State. So, I want to be clear this is not out of some desire of SpaceX to just hire people with green cards.

The DOJ is suing Spacex for not hiring people that the DOJ specifically prevents from working on advanced weapons technology .

He is sued if he doesn’t and is imprisoned if he does.

He is not supposed to have a specific number. But he is not allowed to discriminate against people who are legally entitled to a job. Didn't you read the article?

Rocketry isn't exactly something you'ld usually consider a national secret. Lots of countries have space programs.

Please don't reverse the argument. It doesn't work. Nobody is being forced to take on anyone. They are being told that they have to obey US law regarding employment.

And the laws in Australia are quite similar to those in the US. If you are 'a legal worker', that is, if you have permission to work in Australia without necessarily being a citizen, then you are entitled to apply for jobs and not be discriminated against.

If the job requires top secret security clearance then non citizens wouldn't be able to get clearance except in very specific situations. That applies in both countries. Now if Musk is saying that he cannot employ non-citizens for security cleared employment then he's right. But he's not saying that. He's saying 'US law requires at least a green card to be hired at SpaceX'.

In the first instance, export control laws impose no such hiring restrictions. And in the second, refugees and immigrants are eligible for green cards. So he is obliged not to discriminate against immigrants and refugees. Thems the rules. He has to follow them. It appears that he hasn't.

I can't.

...Because there were no legal immigrants who were discriminated against at SpaceEx. The ones who didn't get the job weren't chosen because there were better candidates, so they simply didn't get hired.

That's not true according to the DoJ. From one of the articles:

'It also alleges that in postings SpaceX put on job hunting sites and online forums, SpaceX employees specified available positions were only open to U.S. citizens. On applications, potential employees had to check a box indicating their citizenship status, which was then input into a database that managers and recruiters marked with rejection codes, such as "not authorized to work/ITAR ineligible," "does not meet basic qualifications" and "not U.S. citizen/green card." '
