This could be a thread unto itself, we will have to wait and see if the devices used uploaded any messages into “the cloud”, that may be retrieved by the service-provider.

And the Department of Justice requested that the first defendant from the January 6 insurrection to be convicted at trial, Guy Reffitt, be sentenced to 15 years in prison. This is an upward adjustment of sentencing guidelines because the department is asking the judge to consider Reffitt’s actions as terrorism, since the offense for which he was convicted “was calculated to influence or affect the conduct of government by intimidation or coercion, or to retaliate against government conduct.”

Reffitt was a leader of the Texas Three Percenters militia gang, which calls for “rebellion” against the federal government. He came to Washington, D.C., for January 6. He attacked U.S. Capitol Police officers and encouraged others to do so before entering the Capitol armed with a handgun, where he targeted House Speaker Nancy Pelosi (D-CA) and then–Senate majority leader Mitch McConnell (R-KY).

Also, the National Archives on Tuesday sought more information on “the potential unauthorized deletion” of agency text messages. The U.S. government’s chief record-keeper asked the Secret Service to report back to the Archives within 30 days about the deletion of any records, including describing what was purged and the circumstances of how the documentation was lost.

[Previously, Secret Service spokesman] Guglielmi acknowledged that some data on the phones had been lost in the changeover but emphasized that “none of the texts” the OIG was seeking were missing.


It's still not entirely clear whether this is 'the final answer'.

Help me out here -- I saw this on Twitter and I want to see if I got the timeline correct:

2:12 PM -- VP Pence is rushed off the Senate floor as the rioters close in.

2:24 PM -- Donald Tweets:"Mike Pence didn't have the courage to do what should have been done to protect our Country and our Constitution, giving States a chance to certify a corrected set of facts, not the fraudulent or inaccurate ones which they were asked to previously certify. USA demands the truth!"

At this point, nobody knows exactly where Pence is, but the presumption is that he is still somewhere either in the Capitol or on the Capitol grounds -- now with quite the bulls-eye on his back, thanks in part to Donald's aforementioned tweet.

3:36 PM -- Kayleigh McEnany tweets that Donald has called in the National Guard to the Capitol.

Thanks to the committee hearings, we now know this to be a lie. The National Guard was called in, but it was Pence, not Donald, who called them. Donald ordered McEnany to put out the (false) tweet giving himself the credit for calling in the NG.

(Technically, Pence was usurping presidential authority by calling in the NG himself, but personally, I'll let it slide under the circumstances)

4:08 PM -- Pence, still on the Capitol grounds, calls Christopher Miller to tell him that the Capitol is still not secure, and asking for a timeline to secure the building.

By this time, it's obvious that although the Capitol is, as Pence said, not secure, its security is inevitable, with the presence of Capitol Police and National Guardsmen, as well as reports of incoming NG reinforcements from Maryland and Virginia. For all intents and purposes, it's clear the "insurrection" has failed. The rioters have not seized Pence or any other HVTs, and they cannot hold the capitol.

Presumably, Miller informed Donald of all this after getting off the phone with Pence.

4:17 PM -- Donald releases his prerecorded "We love you. You're very special. Now go home," video, effectively ordering the Capitol rioters to stand down.

That sound about right?

The Secret Service was only able to provide a single text exchange to the DHS inspector general who had requested a month's worth of records for 24 Secret Service personnel, according to a letter to the House select committee investigating January 6, 2021, whose details were first reported by CNN.

"The Secret Service submitted the responsive records it identified, namely, a text message conversation from former US Capitol Police Chief Steven Sund to former Secret Service Uniformed Division Chief Thomas Sullivan requesting assistance on January 6, 2021, and advised the agency did not have any further records responsive to the DHS OIG's request for text messages," Assistant Director Ronald Rowe wrote in the letter to the January 6 committee.

"The Secret Service continues to engage in extensive efforts to further assess whether any relevant text messages sent or received by 24 individuals identified by the DHS OIG were lost due to the Intune migration and, if so, whether such texts are recoverable," Rowe wrote.

Bipartisan group of senators cuts deal to change election laws in response to January 6 attack

According to a fact sheet on the legislation, the proposal dealing with the vice president's role would make clear that the responsibility is "solely ministerial and that he or she does not have any power to solely determine, accept, reject, or otherwise adjudicate disputes over electors."

Democratic Sen. Mark Warner of Virginia said the bill would make it harder to overturn an election when a joint session of Congress convenes to certify a presidential election.

"Anything we can do and show to the American public that we realize how serious that day was, and that we're going to do all we can to prevent a repeat of January 6th, is a step in the right direction," he said.

'Loudmouth' Capitol riot defendant had a rough day at his Jan. 6 jury trial
Matthew Bledsoe, who scaled a wall before entering the Capitol through a door with broken glass panels, tried to convince jurors that he thought he was allowed inside.

When prosecutors confronted him with a text he sent to his wife, saying it was "good" that someone planted bombs near the Capitol, Bledsoe said he really didn't mean "good." He also claimed he didn't really mean it when he wrote that he "stormed the Capitol."

In an attempt to explain why he climbed a wall to get to the Capitol, Bledsoe said his home in Tennessee was "quite a bit different" than D.C., and that he climbed walls back home regularly.

Bannon's lawyer presented no defense.

WASHINGTON (AP) — Lawyers for Trump ally Steve Bannon did not call any witnesses and declined to testify himself in his contempt of Congress trial on Thursday and instead argued the judge should just acquit him, saying prosecutors hadn’t proven their case.


You may recall that Bannon promised to "go medieval" on the court. I didn't think he meant a vow of silence.
