Walking down the street after breaking into a house is not illegal either. But you can still be arrested for breaking into the house

Overstaying a visa is illegal as well as unauthorized entry.
That's how people end up being undocumented.
So it may not be a crime to be undocumented but a crime had to be committed to end up without documentation, unless someone just misplaced it

Crossing the border unlawfully is the ultimate crime in the eyes of MAGA.
Ultimate crime no, but still a crime and worthy of deportation. Immigration is a privilege afforded to those who follow the law. It is not a right to be bestowed on those who break the immigration laws.

I don't think it's illegal to have misplaced your visa, except that you can't prove that you had one.

Certainly we have the technology to digitize visas so that they can be available to police agencies at any time, but we seldom make such good use for technology.

I've read enough of them to see a pattern. I acknowledge there is evidence that certain types of entry into the united states is indeed a crime but it does not appear simply being undocumented is.

I suspect there was some "due process of law" that got skipped.

However, I see the tactic of the Administration is to skip due process and dare the courts to do something about it.

The framers of the Constitution expected that not more than one branch of government would be acting in bad faith at any given time.

Actually, it does. The fact that they earlier lacked legal status was the basis of granting them legal status. They wouldn't have to be granted legal status if the government had not already ascertained that they didn't have it.

Your assertion is as if someone who had once had charges for a crime dropped were to be re-prosecuted for the same crime the next day.
