Supreme Court Takes First Transgender Case.

Apparently, Oral arguments for the case will be sometime in March (2017) or possibly April. Hopefully, Trump's Supreme Court nominee, Neil Gorsuch, will be installed by then.

This will be a landmark case. The court will have to effectively decide who is a man or a women. It will also have define the word “sex,” as found in Title VII of the Civil Rights Act of 1964 and Title IX of the Education Amendments of 1972 as pertaining to the intent and purpose of the law. That word is pivotal for the claim that federal law supposedly allows transgenders to use the restroom of their choice, and it has been grossly mis-interpreted by liberals.

I am praying that the court will rule in favor of the orthodox Christian/biblical position that gender is not a subjective determination left up to individuals to decide; rather, it is objectively determined by birth gender/genetics.

I am also praying that current multi-state, anti-transgenderism legislation being proposed will get passed.


I. Legal State of Affairs


A. Misinterpretation of Federal Non-discrimination Laws:


1. Over the past decade or so, liberal legislators have been defining federal non-discrimination law to suit the transgender/homosexual agenda by liberally interpreting federal law. The United States Equal Employment and Opportunity Commission says,“The EEOC has held that discrimination against an individual because that person is transgender (also known as gender identity discrimination) is discrimination because of sex and therefore is covered under Title VII of the Civil Rights Act of 1964.” That is a gross misinterpretation of Title VII of the Civil Rights Act. Title IX of the Education Amendments of 1972 has also been mis-interpreted.


2. Currently, there is no federal law (despite misinterpretation) that explicitly prohibits discrimination against transgenderism . Title VII simply forbids hiring or employment discrimination based on someones“race, color, religion, sex, or national origin," but does not mention anything about “sexual orientation,” much less gender identity or "perceived gender." Neither does Title IX of the Education Amendments of 1972.


3. A major justification for misinterpreting Title VII and Title IX is liberals treating biological sex separately from perceived gender (gender identity). In other words, the gender that one identifies with determines ones actual “sex" as pertains to the word “sex” in Title VII and IX. With this mis-interpretation, transgenderism advocates claim that Title VII and IX includes protection for transgenders using the restrooms of their choice.


B. The Obama administration’s directive


1. In May of 2016 the Education and Justice Departments issued a directive to the states requiring that transgender students be included in civil rights protections under Title IX. That includes their supposed right to use restrooms and locker rooms of their choice.

a. This directive is being legally challenged by a multi-state coalition headed by the state of Texas.

b. Recently, Trump reversed the Obama administration's transgender bathroom policy directive.


2. Currently, there are 12 states attempting to pass legislation requiring limiting bathroom access based on a person’s biological sex, not perceived gender. Two other states failed to do so.


3. Ultimately, it seems the higher court will eventually have to decide what constitutes a persons true sex: biological/birth gender or perceived gender.

Just out of curiosity, what should one do if they have both male and female functional external organs? This is an actual condition with actual documentation; such people do exist. Also, what if a person is female externally but has internal testes and a Y chromosome? Which bathroom should they use?

Regardless of your stance on transgenderism, it is not possible to regulate bathrooms in any real way. We'd have to do genital checks of every person before they can go in, or do a genetic test to determine chromosomes. I've done that before. It takes hours.

ance on transgenderism, it is not possible to regulate bathrooms in any real way. We'd have to do genital checks of every person before they can go in, or do a genetic test to determine chromosomes. I've done that before. It takes hours.

I'm guessing the court will rule against the government being the genital police. I can't think of anything more authoritarian than to tell people where they can go to the bathroom.

I'll pray that transgender people can live their lives in peace and quiet.
