Suing another Christian because of a fall. Should I do it or not?

Their conscience. God works through our conscience as well as our hearts and spirits.

The problem is that doesn't always happen.

I'm not suggesting that you should have sent flowers to the pedestrian in the hospital. But certainly you got out of the car, checked on him, waited until the police or ambulance came. This business owner apparently didn't to any of that.

Maybe if he had accidentally pushed him into the pothole, he would have.

What I mean is that this wasn't caused by direct activity by the business owner, unlike when I hit the pedestrian.

God is the best insurance you can have. Not only can he heal all manner of sickness.....but He can also prevent you from getting them.....

This. My wife and I are 64 and have no health insurance. We pray every day that He protect us. He has been very faithful. He is the great healer.

It's gotten to the point now where I "feel" like I'm showing a lack of faith when I even entertain the idea of getting health insurance.

No, but as a business owner he is responsible. As I said before, a lawsuit here would be filed against the business but it is really against the insurance company.

Again, a business is responsible to provide safe conditions. This guy apparently did not.

The problem comes with the word "safe". The word has no meaning without a qualifier. In washington state it is illegal to ride a motorcycle without a helmet. It is otherwise considered unsafe. It is also considered unsafe to ride in a car without a seat belt.

However, which is "safer": Riding a motorcycle with a helmet on, or riding in a car without a seat belt on.

So, how safe is "safe", and is the existence of a single pothole considered negligence? Personally, I would expect to watch where I was going, but know that the business owner has insurance that will pay for any injuries incurred on their property, even if it's not necessarily their fault.

A good example: You go to bed at night and wake up to the sound of a siren in front of your house. During the night there was a freezing rain and someone in the very early morning, before you woke up, tried to walk up to your house and slipped and damaged their back on your porch steps. Your homeowners insurance will cover their injury even though you were clearly not negligent.

You are protected and you are healthy. I would suggest, Thanking God every day for these facts, as opposed to asked him to do what is already done.

Most people think about sickness, and their being sick, when they are sick....but forget to think about health when they are healthy......This is very important for those who wish to learn how to pray.

Im not against insurance.....If there is an opportunity to get it at little or no cost, I would without any thoughts concerning my spirituality.

Though I feel bad you fell. Don't be like the person with the coffee who sues when they spill it on them. Just ridiculous. Sounds like you knew all the reasons of why it was not a 'safe' place to walk. You knew the risk. WATCH YOUR STEPS!

Yeah, a guy I know used a weird turn of phrase a year ago. He was working on his live-in girlfriend's brakes and using his girlfriend's dad's old jack to hold up the car. It fell and crushed his ankle. He said he was going to sue her insurance company.

No need to sue, unless they don't cover the damages.

I've learned that Asking the Father is much different than an older child asking there father for something.

When I go to the Father and ask....I have to believe that I have already received what I asked for. therefore saying "protect me" Is like saying "I know I am not protected now, can you protect me in the future" Yet the Father doesnt want us to worry about tomorrow.....only right now. To those who have, more will be given....

The Father has strength, and everything He has is yours already! you just have to take it. So let the weak say......

And you're vision may not always be the best. Also maybe this happened at night? Or maybe there was a small coating of snow so he couldn't see the pothole? People have to be realistic and realize not everyone is as perfect as them when it comes to normal things like walking.

Side note, someone said hes just trying to advantage of the system. Well the system exists for a reason. And since hes older, breaking a bone or injuring oneself means you don't heal as well, or maybe not fully in general. So a small injury could affect your life.

Yes. I'm 64. And I confess that in our current culture the temptation is very high to listen to an ambulance chaser. But the bottom line is that the proprietor's insurance should more than cover it, and if they don't, well, that is when a suit may be in order. That is literally what insurance companies are for.

5 pages and how much LEGAL advice? Blood of Jesus. Who here knows ANY of the people in this? Then don't give out legal advice.

All I can say is.. if it happen to me.. I would go to them and... Thats as far as I can go I dont the people. I was with my wife in a car crash with some pastor friends. I was told by one of them on a phone call.. get in on this you can get allot of money". I had already heard the people were Christians.. coming from Church I believe.. matter not. But said sorry.

The pastor and his wife which are human.. got money. My wifes back was hurt not bad in any way yet hurt had to see a doctor. Yet.. I never acted on that. I said no.

My case is different. They said sorry. Not keeping up keep ..if the law says you should or things like that.
One could have a case. Saying "Christian" and not keeping up what you by law you should. Theres nothing wrong no sin in this. This is between you and them and NO ONE HERE.

So pray and do what your heart says. From just what you said its not about gettings tons of money nor hurting them. We obey all mans laws. If one does not.. you have even in Gods eyes every right. He is the BEST JUDGE!

Why were you on a vacant parking lot, that as you said was un maintained and had many pot holes..?
Water filled frozen potholes are an obvious danger. And shold be avoided not walked over.
The USA is the USA. but in the UK such a claim would be easy to defend and would be thrown out...
But then we would not have a medical bill either.

So your saying you shouldn't ruin the lives of the business owner but its ok for the business owner to ruin someone elses life because they failed to maintain property? Lets say your walking down the sidewalk in Canada and a brick from a building just happens to fall off and smash you in the arm, shattering it and its not really fixable. Are you saying you'd be ok with that and not blame the building owner? Despite the fact your life is now changed?

Legally we have laws about maintaining property. Though it defends on local laws on if its enforceable or not. Better example it lets say you have a child (lets say 6 years old). And your child decides to go swimming in my pool. But then your child drowns. You won't sue me because its not fair to ruin my life? Makes little sense. Granted I could have a fence up so no child could get into my yard. But why would I want to pay money to build one to protect my pool if I can just blame the person whos child went in it?

Again I realize theres a difference between falling and hurting yourself versus a very life changing event. Also not sure why people still say americans like to sue. Talk about stereotypes. Its like bringing up the stereotype that Canadians like to say "eh", they love maple syrup, they love hockey....etc. Just because a stereotype exists doesn't mean its true.

I'd actually argue maybe the problem is that Canadians have a bad legal system, and because of this they get taken advantage of. Where as in america we have a much better legal system that allows people to seek compensation for bad things that happen because of other people who are lazy, ignorant, cheap...etc.

Found out today this business owner owns 4 major restaurants and been in business for 30 years. I'm only asking for my medical bill from the hospital paid which will most likely be 1500-2000 dollars.

True, but that is between them and God. If we follow the ways of Christ, Christ will compensate us and he will deal with them in his way.
