Yes, a person could try to have an opposing party disqualified out of spite. Then the lawsuits happen, and it goes to the courts. If necessary, the Supreme Court is the final word on the matter.Does it have to say anything about being convicted? As without conviction there is no prove in a court of law without conviction anyone could disqualify someone because they "believed" something about a person which may or may not be true or a disqualifying factor. If conviction is not required then a person could try to have an opposing party disqualfied just out of spite. Which I think we can all agree was not the founding father's intend.
