The payments were legal; if they would have recorded that Cohen had “loaned” Trump the money, and Trump I subsequently paid Cohen back, there would have been no crime and no trial.

But they recorded the transactions as “legal expense”, (which denotes hours billed by an attorney (as well as reimbursements for court/filing fees)). That was fraudulent.

The same way that mortgage payments are not legal expenses. Legal expenses are costs incurred for legal services. That can include hourly fees, a retainer, payment for specific services etc. Once the NDA is negotiated it's the same as any contract.
