The court in The Hague will rule on whether the Palestinian Authority is to be considered a state, which would enable a criminal investigation to be opened against the State of Israel with implications for every resident of Judea and Samaria and every soldier who has served across the Green Line. The State of Israel has not officially responded, and one woman will be defending us all.

The chief prosecutor at the International Criminal Court in Hague, Fatou Bensouda, has announced that she will investigate the State of Israel regarding war crimes that, in her view, it is committing in two spheres: first, excessive violence on the army’s part against the Palestinian population; and second, the settling by the State of Israel of its own citizens on occupied land in violation of international law.

The State of Israel is not a party to the Hague court and does not recognize its authority. Accordingly, after Bensouda filed a request with the court to investigate the State of Israel for war crimes, the State of Israel decided not to respond officially to the news in any way.

However, the State of Israel understands that it cannot abandon the international arena to the Palestinian views that are infusing it. Shurat HaDin, the Israel Law Center headed by attorney Nitzana Darshan-Leitner, has picked up the gauntlet.

The intent is for Darshan-Leitner to mount a two-phase defense of the State: initially, she will try to prevent the investigation against the State of Israel from beginning at all; then, if unsuccessful at that, she will return fire in the form of a demand to investigate the Palestinian Authority for a series of war crimes committed against its own residents and against the residents of Israel.

Darshan-Leitner has a simple strategy. She contends that the court has no authority to interfere in the matter because Israel is not a state party to the court and, by international law, the Palestinian Authority is not a state. According to her argument, the matter is not justiciable and is strictly politico-diplomatic.
