He initially agreed to bake the birthday cake, pink with blue frosting, but then reneged when the customer said she intended to also celebrate her transition from male to female.

“We conclude that creating a pink cake with blue frosting is not inherently expressive and any message or symbolism it provides to an observer would not be attributed to the baker,” said the court, which also rejected procedural arguments from Phillips.

“They just object to the idea of Ms. Scardina wanting a birthday cake that reflects her status as a transgender woman because they object to the existence of transgender people,” he said of Phillips and his shop.

The Colorado Human Rights Commission has not joined the lawsuit.

He should have the right to refuse service to anyone.
That's not the way business licenses work. You can refuse service for most reasons but not for belonging to a class of people.

I can appreciate a lawyer wanting to make a legal point. Still, if the ultimate goal is for LGBTQ people and allies to find a way to live in harmony with our conservative neighbors, this seems needlessly provocative. Surely there are other bakeries in Colorado that people can go to; we all know this baker is conservative, and I'd be prepared to leave him alone to live his life. Lawsuits are an important mechanism for justice when we need them, but they should be the last resort, not the first resort. I don't think a sequence of lawsuits is really going to get us to the kind of respectful-yet-diverse community we want to live in. Right now, it looks like we're people who like to pick on bake shops.

How many of these lawsuits have to happen before they get the message - has any of them succeeded?


This is the third time - the Supreme Court ruled - get over it an find another baker.

"This case started the day the Supreme Court decided they were going to hear our case. It was a very busy, very crazy day at the shop," Phillips explained. "In the middle of all of this chaos, we got a phone call from an attorney in Denver asking us to create a cake pink on the inside with blue icing on the outside."​
Phillips told Fox News that he was told "it was two colors, a color scheme, a combination, designed to celebrate a gender transition."​
The customer, Autumn Scardina, an attorney, requested the cake in 2017 in honor of her gender transition.​
"We told the customer, this caller, that this cake was a cake we couldn’t create because of the message, the caller turned around and sued us," Phillips told Fox News. "This customer came to us intentionally to get us to create a cake or deny creating a cake that went against our religious beliefs."​

We don’t jail “them” nor put “them” into mental hospitals anymore, and they should be grateful for that and stay out of public as much as possible?

Everybody has the freedom to make use of public accommodations without discrimination based on their gender.

I just posted a sign from the era of segregation. By your reasoning this should have fully accepted by black people as there were other theaters, they could go and use.
