Trump expresses support for Capitol rioters as he continues to embrace extremist groups


Former President Donald Trump expressed support for the rioters behind the deadly January 6, 2021, attack on the US Capitol in a video played during a fundraiser Thursday that was hosted by the Patriot Freedom Project, a group that assists families of those charged in the riot.

“People have been treated unconstitutionally in my opinion and very, very unfairly, and we’re going to get to the bottom of it,” he said.

One week after the historic seditious conspiracy conviction of Oath Keepers founder Stewart Rhodes, federal prosecutors will try to once again prove that other members of the far-right militia were planning to violently stop Congress from certifying the 2020 presidential election.

The new round of defendants – Roberto Minuta, Joseph Hackett, David Moerschel and Edward Vallejo – are more disconnected from the top brass of the far-right militia. All four have pleaded not guilty.

“I think it’s important not to overstate or frame this as it’s either ‘seditious conspiracy or bust’ for the DOJ,” Jon Lewis, a research fellow at the Program on Extremism at George Washington University, told CNN. “There is still a significant amount of evidence to convict each of these second stack of defendants on the related conspiracy charges.”

Like the defendants in the first trial, Minuta, Hackett, Moerschel and Vallejo allegedly sent several violent messages in the lead up to January 6 and discussed fighting what they viewed as a corrupt government. The men also allegedly contributed weapons to the quick reaction force, and three are accused of entering the Capitol building.

I believe jury selection in OK-Sedition-II started yesterday (or maybe it is today).

Judge Mehta jammed in a trial of a few violent offenders (jury is still out) in between and was supposed to do the Navarro contempt of Congress trial right after OK-Sedition-I, but delays in that trial pushed Navarro back to next year.

Justice Department subpoenas Maricopa County for communications with Trump, allies

"Maricopa County officials confirmed Tuesday that they had received a [DOJ] subpoena for communications with former President Donald Trump, his staffers and his allies.

Similar requests were sent to local officials in three other key battleground states that Trump lost in 2020. They are the first known requests in the probe by special counsel Jack Smith, picked by Attorney General Merrick Garland to oversee investigations into the Jan. 6, 2021, attack on the U.S. Capitol and Trump’s possible mishandling of classified documents at his Florida home.

In Maricopa County, the subpoena comes 17 months after The Republic first reported that Trump and his allies made calls to pressure county supervisors into changing the results of the election that he narrowly lost to Joe Biden in Arizona.

County spokesperson Fields Mosely said Tuesday that officials received the subpoena and "will comply."

Federal appeals court considers Trump’s plea to grant him immunity from Capitol riot lawsuits


A federal judge in Washington, DC, ruled in February that the lawsuits can move forward, denying Trump’s claim that his conduct was shielded by the privileges of the presidency, and now Trump’s attorneys are appealing that decision. [Now the appeal.]

The three lawsuits were filed last year by Democratic members of the House and police officers who defended the US Capitol on January 6, with the suits claiming Trump prompted his supporters to attack.

January 6 committee considers criminal referrals for at least 4 others besides Trump


The panel is weighing criminal referrals for former White House chief of staff Mark Meadows, right wing lawyer John Eastman, former Justice Department official Jeffrey Clark and Trump’s former lawyer Rudy Giuliani, the sources said.

While the criminal referrals would largely be symbolic in nature – as the DOJ has already undertaken a sprawling investigation into the US Capitol attack and efforts to overturn the 2020 election – committee members have stressed that the move serves as a way to document their views for the record.

These Two Men Were Pictured Rifling Through Senate Documents on Jan. 6th. Now, They’re Convicted Felons.


Arrested months apart more than a year ago, the two men, Luke Bender and Landon Mitchell, have Bender’s TikTok account to thank in part for their identification by federal investigators. The FBI observed a post of the duo standing next to each other holding flags outside the Capitol on Jan. 6.

Chief U.S. District Judge Beryl A. Howell returned a verdict on Wednesday finding them guilty of obstructing an official proceeding and five related misdemeanor charges.

The top count against them carries up to a 20-year maximum prison term, though most Jan. 6-related sentences for this offense to date have been much lower.

A Texas man charged in the January 6, 2021, attack on the US Capitol pleaded guilty Monday to threatening Rep. Alexandria Ocasio-Cortez on Twitter shortly after the riot.

On January 6, in the hours after the Capitol had been cleared of rioters, Ocasio-Cortez, a New York Democrat, posted a Tweet saying, “Impeach.” Garret Miller replied: “Assassinate AOC.”

Miller also pleaded guilty to assaulting, resisting or impeding officers, and admitted to intentionally forcing his hands on an officer while they tried to remove him from the Capitol that day.

The defense appears to be "These guys are all losers." While true, this does not establish innocence.

“These people had Twitter fingers, not trigger fingers,” said Moerschel attorney Scott Weinberg, ridiculing the government’s depiction of defendants as armed militants threatening democracy and paraphrasing rap artist Drake.

Weinberg said the Oath Keepers was headed by an “incompetent” and manipulative “right-wing televangelist” in Rhodes, who lives off members’ $50 dues and sought “to ride in Trump’s wake to get as much publicity as he could.”

“This was not some highly organized group. It was really a bunch of people that were out of shape, overweight, elderly and who wanted to play military,” Weinberg said.

That's part of it, but even this part is really about the nature of evidence and intent relating to the possible crimes.

For the guy using a weapon on someone (in this case a cop), video of the attack *is* the main evidence. (Other evidence would include identification of the attacker and victim and any other aspects of the circumstance.) Assault itself is the crime and that's pretty much all that is needed to charge and convict without an affirmative defense (like self defense.)

White collar crimes are often things that are legal if the purpose is legal. Intent often *really* matters and intent is much harder to prove than simple actions. For example, paying your landscaper from your Br. Virgin Islands bank account isn't illegal. Doing so to avoid paying US taxes on the foreign income you transferred to BVI is tax evasion and money laundering. Etc.

The subversion is certainly a violation against the American people, but can it be tied to a specific crime and proven? That is the real question and there is almost certainly lots of information we don't have. For these Congressmen, they certainly had the opportunity and privilege to object to slate of electors from any state, but if they did so as part of plan in coordination with an attempted take over of the Capitol (or grounds) then they're probably in a criminal conspiracy, but that would have to be proven.

With out the evidence of coordination and/or planning being made available, it is very hard to tell who that looks like a possible conspirator actually was. Trump's allies had perfectly legal reasons to object to electors or plan rallies and most involved in either activity many have had no idea that a criminal conspiracy was going on beside them.

Proud Boys member is first to plead guilty to seditious conspiracy
Jeremy Bertino, a top lieutenant to Proud Boys leader Enrique Tarrio, pleaded guilty to seditious conspiracy in federal court on Thursday, and is cooperating with the Justice Department’s investigation into the far-right extremist group.

According to the Proud Boys seditious conspiracy indictment, Bertino was in a number of encrypted group chats meant to plan for January 6. The groups, including the main “Boots on Ground” channel, included all of the Proud Boys sedition defendants – Tarrio, Ethan Nordean, Joseph Biggs, and Zachary Rehl. They have pleaded not guilty.

Biggs filed a motion for a change of venue on Tuesday, asking the judge to move his trial to Alexandria, Virginia.

“Biggs has been convinced since the time of the first evening of the U.S. House of Representatives Select Committee’s televised proceedings on June 9 of this year that prejudice against all the defendants… is ‘so great’ under Fed. R. Crim. P. 21 that each Proud Boy defendant (and arguably Biggs, especially) ‘cannot obtain a fair and impartial trial’ in the District of Columbia,” the motion read.


Dude, they were televised.
