Man charged in January 6 Capitol riot after calling FBI admitting he was there in an effort to 'clear his name'

According to court documents filed July 6, Fontanez Rodriguez called the FBI National Threat Operations Center on Jan. 22, 2021, to “clear his name” about the Jan. 6 riots that attempted to interrupt the certification of Electoral College votes in the 2020 presidential election.

The messages included photos of the two men posing on the Capitol steps and standing before a Black Lives Matter poster with Fontanez Rodriguez’s knee on Kostolsky’s neck, apparently imitating a Minneapolis police officer’s actions in the George Floyd killing that sparked Black Lives Matter protests across the country.

Classy.

The Justice Department has issued several subpoenas to Republican operatives connected to the scheme to put forward "alternate" electors, and the grand jury heard testimony from "Stop the Steal" organizer Ali Alexander in June.


Earlier this year, he "quietly testified before the House select committee"

Mark Ponder, who assaulted police officers on Jan. 6, sentenced to 63 months in prison

The man, Mark Ponder, 56, was arrested in March 2021 in Washington and pleaded guilty in April to assaulting, resisting or impeding officers using a dangerous weapon.

Ponder was detained by Metropolitan Police officers and told law enforcement, "When our country is being attacked with, like we are, we have a right to fight ... that is what the Second Amendment was built on," according to his plea agreement.

He also told the [FBI] agents "the way this country is going, you gonna have to pick a side," court filings said.

One of two men charged in the Jan. 6, 2021, chemical-spray assault on three police officers at the U.S. Capitol, including Brian D. Sicknick, pleaded guilty to reduced charges Wednesday.

West Virginia sandwich shop owner George Tanios, 40, admitted to two counts of misdemeanor trespassing and disorderly conduct on restricted Capitol grounds, a reduction from an earlier 10-count indictment that included felony charges of rioting, assaulting law enforcement officers and obstructing of Congress’s certification of President Biden’s 2020 election victory.

In the plea, Tanios admitted to bringing two cans of chemical spray to Washington and giving one to [Julian] Khater prior to arrival at the Capitol.

Neither Tanios or Khater is alleged to have caused Sicknick’s death.

This discovery of missing records for the senior-most homeland security officials, which has not been previously reported, increases the volume of potential evidence that has vanished regarding the time around the Capitol attack.

The telephone and text communications of Wolf and Cuccinelli in the days leading up to Jan. 6 could have shed considerable light on Trump’s actions and plans. In the weeks before the attack on the Capitol, Trump had been pressuring both men to help him claim the 2020 election results were rigged and even to seize voting machines in key swing states to try to “re-run” the election.

Wolf had resigned five days after the attack on the Capitol, and cited “recent events” as well as legal rulings questioning his legitimacy to continue leading the department as an acting secretary for 14 months.

A Government Accountability Office report in 2020 found that Wolf and Cuccinelli were ineligible to serve in their positions because their appointments had not followed the proper order of succession, an issue the GAO referred to the DHS Office of Inspector General.

“There is NOTHING WRONG with talking to the DOJ and telling them your friends are innocent," said Brandon Straka, who was convicted for his actions in the Jan. 6 U.S. Capitol siege.

According to the unsealed documents, some of the information that he provided to the FBI was derogatory in nature and could support criminal charges. But his GETTR post ignored that, and he instead wrote that the majority of the people he spoke to the FBI about were his friends and that he didn't say anything negative about them.


Speaking of negative things. Previously in Brandon Straka:

Shortly before his plea, Straka addressed 357,000 Facebook followers as “Patriots,” urging them to tune out “negative press … likely coming down the pike” as he took the first meaningful step toward concluding “the perils of the situation I am in.”

Ignore that I ratted you out for a lighter sentence.

The Department of Homeland Security’s chief watchdog scrapped its investigative team’s effort to collect agency phones to try to recover deleted Secret Service texts this year, according to four people with knowledge of the decision and internal records reviewed by The Washington Post.

Staff at Inspector General Joseph V. Cuffari’s office planned to contact all DHS agencies offering to have data specialists help retrieve messages from their phones, according to two government whistleblowers who provided reports to Congress.

But later that month, Cuffari’s office decided it would not collect or review any agency phones, according to three people briefed on the decision.

Late Friday night, Cuffari’s spokesman issued a statement declining to comment on the new discovery.

Cuffari, a former adviser to Arizona Gov. Doug Ducey (R), has been in his post since July 2019 after being nominated by Trump.

In a 28-page filing, prosecutors said a law enforcement search on Jan. 19, 2021, of the home of charged co-defendant Thomas Caldwell, a retired Navy intelligence officer from Berryville, Va., recovered a document that included the words “DEATH LIST” handwritten across the top with the name of a Georgia election official and a purported family member of the official. Both were targets of baseless accusations that they were involved in voter fraud in the 2020 presidential election, prosecutors said.

Alleged Oath Keeper Thomas Caldwell had a 'death list' including the name of an election official and their family. His lawyers say it's a 'doodle pad.'

"This document is not a 'list' but, rather, a doodle pad. The words 'death list' are written in all caps, whereas the balance of writing on the doodle pad is written in upper and lower case letters," read the defense's motion to exclude the note pad evidence.

"Moreover, the words 'death list' are separated from the names of the election workers by scribbled writing, and were clearly written with a different pen. There are no other names on the 'list,' because it is not a list. Importantly, the names written on the doodle pad were not, as the Government claims, election 'officials' but, rather, temporary election workers."
