A Manhattan pickup artist facing federal charges over the US Capitol riot was sentenced to three and a half years in prison Monday for hoarding weapons in an Upper East Side apartment.

Samuel Fisher, 33, apologized to the court and to his family before Acting Justice Robert Mandelbaum handed down the punishment on the state charges.

Fisher, who according to reports once ran a coaching service aimed at helping men get dates, also stands accused of attending the Jan. 6 riot in Washington DC with a small arsenal.

In [a social media] post, titled “January 6, 2021 Will Be the Most Historically Important Day of Our Lives,” Fisher stressed the need to “stand up to the evils of this Government… and remove them physically.”

[The day after the riot] “People died . . . but it was [doggone] great if you ask me . . . i got tear gassed and pepper sprayed,” the messages said. “Seeing cops literally run . . . was the coolest thing ive ever seen in my life.”

“All he has is love for his family and for the country and for everyone,” one of Fisher’s supporters told reporters while sobbing. “He just believes in the Constitution,” claimed the man, who said that Fisher used to babysit his children.

The panel announced Thursday that it will commence contempt proceedings Monday against Dan Scavino, Jr. and Peter Navarro.

The House voted Wednesday to recommend two former advisers to former President Donald Trump be referred to the Department of Justice on criminal contempt of Congress charges.

The House select committee investigating the January 6, 2021, Capitol Hill riot is looking to hold Trump White House deputy chief of staff Dan Scavino and Trump's onetime trade adviser Peter Navarro in contempt of Congress for their refusal to cooperate with the panel's investigation or appear for their respective scheduled depositions.

The leader of the West Virginia chapter of the Proud Boys pleaded guilty on Wednesday to illegally entering the US Capitol grounds on January 6, 2021.

Jeffrey Finley, 29, faces up to one year in prison.

In the days after the riot, according to the plea agreement, Finley deleted photographs, videos and messages with other Proud Boys at the Capitol. Finley instructed other members to do the same.

Jan. 6 committee dials up focus on social media’s role in insurrection

The House committee investigating Jan. 6 is ratcheting up its inquiry into the role social media played in the attack on the Capitol, canvassing experts for research on the matter and hiring a new analyst to help lead the effort, people familiar with the matter told The Technology 202.

The panel has also recently brought on a prominent disinformation scholar, Dean Jackson of the Carnegie Endowment for International Peace, as a lead analyst

The panel dramatically escalated its investigation into how social media factored into the Jan. 6 attack earlier this year, issuing subpoenas for information to Twitter, Reddit and the parent companies of Facebook and YouTube.

Rep. Bennie G. Thompson (D-Miss.), who chairs the Jan. 6 committee, said they opted to issue subpoenas after receiving “inadequate responses” from social media companies to their informational requests.

Los Alamos-based Energy Department contractor Matthew Martin lost his job and top-secret-level clearance after breaching the Capitol

U.S. District Judge Trevor N. McFadden, a 2017 Donald Trump appointee who served in the former president’s administration’s Justice Department, acquitted Matthew Martin of Santa Fe, N.M., of four misdemeanor counts of trespassing and disorderly conduct in a bench trial — handing the Justice Department its first defeat in a Capitol breach prosecution.

About 384 people like Martin face only misdemeanor counts in the Capitol siege — or roughly half of the more than 770 people federally charged. About 150 of more than 200 people who have pleaded guilty have admitted to misdemeanor offenses only

Martin said [in his defense at trial] he did not understand the significance of torn-down plastic fencing that he crossed, nor appreciate that people massed on the east center steps of the Capitol were not allowed there.

Assistant U.S. Attorney Michael Romano called the defendant’s claims of innocence “ludicrous.” He added that Martin showed consciousness of guilt when his Los Alamos supervisor texted him that night, admonishing, “You can’t overrun the capital building.”

“Actually you can, rather easily, I might add,” Martin replied. “Not as much security as you might think. Our numbers were freaking huge. They were not prepared.”

Former President Donald Trump, in an interview published by The Washington Post on Thursday, said that he wanted to march alongside his supporters during the Jan. 6, 2021, riot at the Capitol, but the Secret Service would not allow it.

Throughout the Washington Post interview, Trump refused to accept blame for the Capitol riot, instead accusing Speaker Nancy Pelosi (D-Calif.) and the mayor of Washington, D.C., of being responsible for the escalation.

“I thought it was a shame, and I kept asking, ‘Why isn’t she doing something about it? Why isn’t Nancy Pelosi doing something about it? And the mayor of D.C. also.’ The mayor of D.C. and Nancy Pelosi are in charge,” Trump said.

“I hated seeing it. I hated seeing it. And I said, ‘It’s got to be taken care of,’ and I assumed they were taking care of it.”

He said the committee’s interview with his daughter Ivanka Trump for eight hours this week was a “shame and harassment,” though he insisted he did not know what she had told the members. He said he also did not know what her husband, Jared Kushner, had told the committee, and that he had offered the couple “privilege” if they wanted it. They declined, Trump said.

Trump said he had not destroyed any call logs from the afternoon of Jan. 6 and took part in no phone calls on “burner phones,” even though there is a large gap in his White House phone logs. Trump said that he remembered talking to House Minority Leader Kevin McCarthy (R-Calif.), Rep. Jim Jordan (R-Ohio) and other people during that period. He said he had a “very good” memory but could not say exactly who he talked to that afternoon, or when.

Member of Proud Boys leadership pleads guilty to US Capitol attack charges and will cooperate with prosecutors

Charles Donohoe, 34, is the first person in the Proud Boys leadership to plead guilty and to assist the Justice Department's investigation against the pro-Donald Trump group.

He pleaded guilty to conspiracy to obstruct an official proceeding and assaulting an officer and could provide vital information to prosecutors about what the top members of the organization had planned for the attack.

Prosecutors have gained momentum recently in their investigation into the Proud Boys. Prosecutors cracked the phone of Proud Boys leader Enrique Tarrio in March and have said in court that there is new evidence that could lead to additional charges or arrests in that case.

Two days before the riot, Tarrio was arrested in DC and instructed the members to carry out what they had planned for January 6, prosecutors say.

'We control them all': Donald Trump Jr. texted Meadows ideas for overturning 2020 election before it was called

The November 5 text message outlines a strategy that is nearly identical to what allies of the former President attempted to carry out in the months that followed. Trump Jr. makes specific reference to filing lawsuits and advocating recounts to prevent certain swing states from certifying their results, as well as having a handful of Republican state houses put forward slates of fake "Trump electors."

If all that failed, according to the Trump Jr. text, GOP lawmakers in Congress could simply vote to reinstall Trump as President on January 6.

"We have operational control Total leverage," the message reads. "Moral High Ground POTUS must start 2nd term now."

The text from Trump Jr. is revealing on a number of levels. It shows how those closest to the former President were already exchanging ideas for how to overturn the election months before the January 6 insurrection -- and before all the votes were even counted. It would be another two days before major news outlets declared Joe Biden the winner on November 7.

The text also adds to a growing body of evidence of how Trump's inner circle was actively engaged in discussing how to challenge the election results.

Specifically, Trump Jr. previews a strategy to supplant authentic electors with fake Republican electors in a handful of states. That plan was eventually orchestrated and carried out by allies of the former President, and overseen by his then-attorney Rudy Giuliani.

"Republicans control Pennsylvania, Wisconsin, Michigan, North Carolina etc we get Trump electors," Trump Jr. adds. [<---this would amount to the state legislatures overturning democratic elections.]

A federal judge signaled Friday that she'll likely allow a group of Georgia voters to move forward with their constitutional challenge against GOP Rep. Marjorie Taylor Greene, which claims she can't run for reelection because she aided the January 6 insurrectionists.

Federal Judge Amy Totenberg of the Northern District of Georgia said during a lengthy hearing that she has "significant questions and concerns" about a recent ruling in a similar case, which blocked the same challenge against Rep. Madison Cawthorn, a North Carolina Republican.

Proud Boys leader admits plan to storm Capitol and will testify against others
Charles Donohoe pleaded guilty to conspiracy and acknowledged the intention to stop the electoral college vote

In a new statement of offense, prosecutors said “Donohoe understood that the purpose of the rally” in Washington on Jan. 6 was “to stop the certification” of the electoral college vote. The Ministry of Self Defense leadership was broken into a “marketing” council of three people to recruit more members and an “operations” group. Donohoe was part of the marketing group, which soon expanded to at least 65 members.

As early as Jan. 4, prosecutors said, “Donohoe was aware that members” of the Ministry of Self Defense leadership “were discussing the possibility of storming the Capitol” and “believed that storming the Capitol would achieve the group’s goal of stopping the government from carrying out the transfer of presidential power. Donohoe understood that storming the Capitol would be illegal.”

The conspiracy charge Donohoe pleaded to carries a sentencing range of 97 to 121 months, but credit for acceptance of responsibility and entering an early plea reduced his sentencing range from 70 to 87 months.

Emily Hernandez, 22, became one of the most well-known faces of the Capitol attack after pictures and videos of her went viral ... grinning widely while appearing to hold the purloined piece of Pelosi’s nameplate.

Also pictured with Hernandez are her uncle, William Merry, 63, and his friend Paul Westover, 53.

[All three pleaded guilty to various charges.]

On Monday, U.S. District Judge James Boasberg sentenced all three defendants to jail: Hernandez to 30 days, and Merry and Westover each to 45 days for their role in the mob that overwhelmed police and swarmed the Capitol, temporarily blocking Congress from certifying the result of Joe Biden’s win in the 2020 presidential election.

Hernandez in a separate incident from a year later "is charged with driving while intoxicated resulting in the death of a non-passenger, and driving while intoxicated resulting in serious physical injury."

A Missouri State Highway Patrol summary of the crash said that Hernandez was driving the wrong way on Interstate 44 when she crashed into a car driven by Ryan Wilson, 36. Wilson’s wife, Victoria Wilson, 32, was killed.

A federal judge has informed a defendant in the highest-profile conspiracy cases stemming from the Jan. 6 storming of the Capitol that he will need to find a new attorney because his lawyer has been disbarred.

During a hearing Friday in the seditious conspiracy case against 10 alleged leaders and members of the Oath Keepers militia, U.S. District Court Judge Amit Mehta informed defendant Kelly Meggs that lawyer Jonathon Moseley cannot continue to defend him as a result of an action a panel of Virginia judges took last week to revoke Moseley’s right to practice law in that state.

Thompson testified that after a year without work, he had felt good when Trump told the crowd they were "stronger" and "smarter" than anybody. He then went to the Capitol, Thompson said, because he "felt like I had to do something to gain his respect, his approval."

Also on November 7, Roy wrote to Meadows, “We need ammo. We need fraud examples. We need it this weekend.”

Then came the now-infamous news conference on November 19, where members of Trump’s legal team – including Powell, Rudy Giuliani and Jenna Ellis – laid out a series of false claims and conspiracy theories about alleged voter fraud.

“Hey brother - we need substance or people are going to break,” Roy texted on November 19, a few hours after the news conference wrapped.
Two hours later, Lee texted Meadows with serious concerns, saying he was “worried about the Powell press conference.”

Dec 31 - “The president should call everyone off. It’s the only path. If we substitute the will of states through electors with a vote by congress every 4 years… we have destroyed the electoral college… Respectfully,” Roy wrote.

Jan 3 - “I only know that this will end badly for the President unless we have the Constitution on our side,” Lee texted in a note to Meadows. “And unless these states submit new slates of Trump electors pursuant to state law, we do not,” Lee wrote to Meadows.


Certainly they wanted Trump to be president again, but they saw the plan that had been created, and partly carried out by some of their colleagues, was unconstitutional.

Another detail I'd missed:

Dustin Byron Thompson, 38, did not contest the allegations, specifically that he broke into the Senate parliamentarian’s office twice and stole a bottle of bourbon and a coat rack.

That was the 5th misdemeanor [Theft of government property, value < $1000] (in additional to the usual bundle of trespass charges DOJ has been handing out as party favors).
