Once again, treaties are the supreme law of the land, equal to the Constitution. A state cannot violate the Constitution, and it cannot violate the terms of a treaty.

Citation please..... And explain why the strict Constitutionalists on the SCOTUS think otherwise.

This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.

And the Supreme Court has ruled that state laws must conform to the U.S. Constitution and to treaties, which are the supreme law of the land. States cannot establish official religions any more than the federal government can. :wave:

The Obama administration, joined by high level diplomats and foreign officials, asked the Supreme Court to delay Leal's execution so he would be alive long enough to benefit from legislation pending in Congress. The bill would require court reviews of cases where convicted foreign nationals didn't get access to a consulate.

In a 5-4 decision, the court rejected the argument that more time was needed to allow Congress to take action on an international treaty obligation calling for a review of Leal's case and others like it.



"Our task is to rule on what the law is, not what it might eventually be,” the justices wrote. “We decline to follow the United States’ suggestion of granting a stay to allow Leal to bring a claim based on hypothetical legislation when it cannot even bring itself to say that his attempt to overturn his conviction has any prospect of success.”

I'm not commenting on this particular case. I was simply correcting your earlier claim that treaties do not apply to the states.

Better yet, how about if Mexico accepts responsibility for the brutal rape and murder committed by one of it's illegal emigrants

1. The U.N. can take a leap off the face of the earth. I have no use for them, at all. They've been incompetent, intrusive and that's not to mention impotent. Kick 'em out, demand back pay, and tell 'em to scrap every document with a US signature.

Leal, who was convicted for the 1994 rape and murder of a 16-year-old girl...​

If there's ever been a reason to adopt a foreign country's policy, this is it. Let's adopt Mexico's illegal immigrant policy.


Oh yeah- One last thing. Totally saw these names coming:
In their dissent, the four justices, led by Stephen Breyer, urged that Leal's execution be delayed. "It is difficult to see how the state's interest in the immediate execution of an individual convicted of capital murder 16 years ago can outweigh the considerations that support additional delay, perhaps only until the end of the summer," said Breyer, who was supported by Justices Ruth Bader Ginsburg, Sonia Sotomayor, and Elena Kagan.

It figures.

In order to know whether he was entitled to seek aid from the Mexican consulate, the authorities would have had to determine his immigration status. Ironically, this administration is suing Arizona to stop them from implementing a law that would enable law enforcement to do precisely that.
