Well partial birth abortion is a different story... I think it's very well possible that could be banned since many people on both sides of the fence pretty much think it's murder. Abortion in general, however, is here to stay. I sincerely doubt Roe vs. Wade will ever be overturned. What I thought was funny is that I heard an Obama ad by Planned Parenthood (and Obama said he supported it at the end) on the radio that said "IF JOHN MCCAIN BECAME PRESIDENT, HE WOULD MAKE ABORTIONS ILLEGAL."
ROFL. Yeah right. Good luck with that buddy
Roe VS Wade could definitely be overturned, there are court cases going on currently that are on that very subject, and they will litigate for as long as it takes to get it back up to the supreme court.
one thing to remember was that abortion was made legal through illegal means in our country, no matter your view of the subject anyone who knows how the government works knows that the judicial should not be able to legislate from the bench however they have gotten away with it a number of times.
as for a president making abortion illegal, perhaps not entirely, but he can sure put a strangle hold on it. for starters they can define when a child is actually considered a person ... this of course has already been done but it needs to be reestablished for this particular issue before it would change anything. As far as the law is concerned however once a woman is pregnant that child is a person ... the fact that abortion is legal is some what of a paradox but again i refer you to the fact that it wasn't law passed through the legitimate routes.
however consider this ... a person who harms or kills a pregnant woman in such a way that the baby inside of her is lost is charged with 2 murders, not one. so legal precedent is already in place to consider the unborn child a person and to consider what they do murder. the abortion crowd have created somewhat of a gray area bubble around it though(where none should rightfully exist); much in the same way the euthanasia crowd have for the "mercy killing" of older folks, or people they deem to be beyond medical help.
BTW Obama supports in infanticide ... he turned down bills to make illegal the act of putting to death babies that were born even though abortions were attempted. That is, women who have an abortion, but it somehow fails, so once the baby is born and out of the mothers belly, they put them to death to make up for the botched procedure. His excuse was that the bills did not allow provisions that would make sure they did not affect current abortion rulings and the thing was that after he rejected it on that basis the first times they brought back one that did protect the other current status they just wanted to make sure that people wouldn't kill babies that were already born ... he voted against it, not cool
