The DOJ admitted they made a mistake. The mistake was sending him the El Salvador. They could have deported him to somewhere else.
I don't care. Garcia did in fact receive due process, and in that process, he was found to a MS-13 gang member, a threat to society, and likely to flee. This is why his request for bond was denied.Multiple court rulings, legal documents, and investigations found claims that Garcia belonged to MS 13 to be unsubstantiated. Also see post #61.
In short, you are wrong. His clothing was not the determining factor. "Respondent's gang membership, rank, and gang name is sufficient to support that the Respondent is a gang member, and the Respondent has failed to present evidence to rebut that assertion."In short, the reasons for deeming him a gang member were his clothing,
Why are Democrats supporting a violent gang member?
"According to court filings, Garcia’s wife sought a domestic violence restraining order against him, claiming he punched, scratched, and ripped off her shirt, among other harm."

It's very typical of domestic abuse victims not to follow through on prosecution. He did beat her with his fists. In addition her situation was even worse because Garcia was a high ranking member of MS-13. That means if she does not support him she is well aware the next time the beating will be worse and she could wind up dead. You need to realize the brutality of these gang members. Here's an example of what they did to boys and young men who mocked them:Abrego Garcia’s wife responds to Trump administration publicizing civil protective order filing from 2021
In a statement to CNN, Vasquez Sura said she sought a civil protective order after a disagreement with Abrego Garcia. Vasquez Sura noted she had survived a previous relationship that included domestic violence. She did not appear at a court hearing and the matter did not proceed.
“Things did not escalate, and I decided not to follow through with the civil court process,” she said in the statement. “We were able to work through this situation privately as a family, including by going to counseling. Our marriage only grew stronger in the years that followed. No one is perfect, and no marriage is perfect.”
“That is not a justification for ICE’s action of abducting him and deporting him to a country where he was supposed to be protected from deportation,” she added. “Kilmar has always been a loving partner and father, and I will continue to stand by him and demand justice for him.”
Like the rest who were sent to the prison he was legally deported. How is his character and if he is a gang member in any way relevant? The fact remains that the Trump administration illegally deported him and has, to date, refused to correct their error.
No, there was a judges order that he not be deported. The SCOTUS has clarified this point. He was not legally deported.Like the rest who were sent to the prison he was legally deported.
The ruling is being appealed. The supposed threat from a rival gang is moot because that gang no longer exists. Thus there is no reason to bring him back and send him to a facility in Egypt or anywhere other than El Salvador. No, there was a judges order that he not be deported. The SCOUS has ruled. They deported him illegally. You don't get to take the action THEN appeal the ruling. The ruling is being appealed. In America you do.The SCOUS has ruled. They deported him illegally. You don't get to take the action THEN appeal the ruling.
The government will soon file an appeal. But as it stands El Salvador refuses to release their own citizen to the United States. The courts have no authority over a foreign nation. No, there was a judges order that he not be deported. The SCOTUS has clarified this point. He was not legally deported.
To this day, the Government has cited no basis in law for Abrego Garcia’s
warrantless arrest, his removal to El Salvador, or his con-
finement in a Salvadoran prison. Nor could it. The Gov-
ernment remains bound by an Immigration Judge’s 2019
order expressly prohibiting Abrego Garcia’s removal to El
Salvador because he faced a “clear probability of future per-
secution” there and “demonstrated that [El Salvador’s] au-
thorities were and would be unable or unwilling to protect
him.” App. to Application To Vacate Injunction 13a. The
Government has not challenged the validity of that order.
Guess it is a good thing we have Mr. "Art of the Deal" to back up our extradition treaty that we have with El Salvador. The government will soon file an appeal. But as it stands El Salvador refuses to release their own citizen to the United States. The courts have no authority over a foreign nation.
In America parties in lawsuits comply with court orders until an appeals court reverses the ruling or risk contempt penalties. In America you do.
Yes you are correct on that account. I thought that was order. My mistake. However I made no mistake involving the previous courts. That is not the Court's ruling. That is the filing from the DoJ asking the Supreme Court to lift the district court's injunction.
ETA: The ruling from the Supreme Court can be found here:
The only statement made about Garcia's supposed membership in MS-13 is this statement of the facts of the case:
Barrio 18 still exists and is active in El Salvador. The supposed threat from a rival gang is moot because that gang no longer exists. Thus there is no reason to bring him back and send him to a facility in Egypt or anywhere other than El Salvador.
Not if the government there took him. The order only forbade them from sending him to El Salvador. The government screwed up. SCOTUS stated they did and he should have gotten due process which he didn't. I think he should have. Are you suggesting the U.S. government should send an El Salvadorian citizen to a country other than his own? Wouldn't he be undocumented there?
Not hardly.Barrio 18 still exists and is active in El Salvador.https://insightcrime.org/news/special-series/downfall-el-salvadors-gangs-costs/
