Which is of course different from actually refusing anything.

Refusing comes after he gets his final orders after appeals.

Appealing and complaining are quite less severe actions than refusing your orders with lesser consequences.

US has absurd incarceration rates.

If they have gotten rid inmates with lesser offenses and all that is left is the hardcore criminals ready to annihilate the society sure keep those people in.

Just hard to figure who is going to do accurate determination. The system that locked up all those people in first place ?

Private prison lobbyists ?

I think it's very likely that a higher court will overturn the judge's decision. At the very least, the Supreme Court isn't likely to let a bunch of rapists and murderers be released into the community just because COVID-19 is present in the prison. With the virus running rampant throughout the state, the prison is probably not much worse off than anywhere else.

By the time the conflict is resolved, they might have the vaccine available.
