Ruth Bader Ginsburg's past comments raise questions about Supreme Court retirement

To be completely clear: I hope and pray she fully recovers and continues her life’s work. She has certainly earned it.

But can you imagine the full mental and emotional breakdown of the left if the President has the opportunity to appoint a third judge to the Supreme Court?

I agree. i surely AM praying for Ruth Bader Ginsburg, that God's mercy extends to her for questionable if not downright dark positions throughout her life that do not protect, and further make it easier to boost child trafficking, etc.

I'm praying that she repents before her very frail life ends and that she extricates herself from those forces she has supported that hurt and came against the most helpless and vulnerable amongst us.

We might see a strong reaction instead of a breakdown. The goal of Trump's judicial appointment policy is the destruction of the First Amendment. Those of us who are not right-wing fundamentalist Evangelicals have a lot to lose if Ginsburg is replace by another conservative justice.

Maybe I'm mistaken, but I get the impression some people are chomping at the bits for her to die. It's like their excitement is masqueraded by an alleged concern for her failing health. It seems like they're already dancing on her grave and they can't wait until she dies so they can get a conservative Justice.

It's not that you just disagree with her. It's that her soul is MORE utterly irredeemable than yours (except through God's grace).

It's not that she is a loving caring mother, INCREDIBLY intelligent, bright woman who has done a lot to support and fight for the down trodden and the "least of these". Nope it's that "THE LEFT" has her trapped.

This thread is an opportunity to view someone you disagree with politically as a person instead of a monolith (or the "victim" of a monolith).

Politics is only one aspect of who a person is. We know politicians for their politics but they are mothers, fathers, brothers, sisters, grandmother/fathers with lives, interests, and stressors all their own. If she comported herself in her private life like a trainwreck, then I would say it would be a fine time to disagree with her and I would understand where disrespect would come from. But this is just politics.

But it would seem a lot of people who are 85, lived through a couple of cancer battles, broken bones, etc., would like to enjoy their remaining years not working. Maybe traveling or spending time with friends and family or whatever.

Personally, I think the left is afraid she will die while Trump is in office, giving him another SC appointment opportunity, and thereby creates the false narrative that the right doesn't care about her health or her personally, just her position on the court.

I really doubt that RBG will retire while Trump is president if she can help it.

But after January 2020 it’s ok, right? McConnell says we should not consider a SCOTUS nominee in a presidential election year. Certainly he will play by the same rules when a Republican nominates someone.

Actually, who am I kidding - McConnell doesn’t have any scruples.

Should Trump stack the court there ARE solutions. A future president could add justices to achieve balance--and the people might enthusiastically support that.

A Democratic government could change the lifetime appointment rule.

Roberts could move towards the center. I feel sure he would not support Trump's trying to prevent Congress and the public from reading the Mueller Report due to executive privilege.

Such a move would in itself constitute obstruction of justice.

The claim that Justice Ruth Bader Ginsburg is unable to perform the duties of her job due to her health is erroneous. Though she was not present for oral arguments, Chief Justice John Roberts said Ginsburg would participate in the cases by reading briefs and argument transcripts. She's famed for her work ethic. In addition to reviewing relevant case material from home, Ginsburg has also voted in matters before the court. There is no rule prohibiting justices who are missing from the bench from casting their votes, and thus fulfilling their duties. She is most certainly not setting a precedent. Chief Justice William Rehnquist worked from his home for a substantial part of a year after recovering from a surgery in connection with his diagnosis of thyroid cancer (which unfortunately was already aggressive at the time it was caught). Justice John Paul Stevens, who presided over the court during Rehnquist's absence, clearly stated that justices reserved the right to vote in cases before the court, including those in which they are not present for oral arguments. RBG is also not the oldest member of the court. Justice Oliver Wendell Holmes and Stevens retired at 90. Though I'm sure she'd appreciate sincerely given thoughts and prayers I think she's far more concerned about the Americans who are unable to perform the duties of their jobs, or being forced to perform them without pay because of the federal shutdown, and the tremendous ramifications of it that is impacting even more lives (millions).

Justice Ginsburg's prognosis is very promising. My dad is an oncologist, and he views her fall in November that resulted in broken ribs as an act of divine providence because it is what enabled doctors to see the cancerous cells in her lungs on the X-rays, and take swift action. Her physicians confirmed her NED status (No Evidence of Disease) following surgery in December. Top oncologists in the country expect her to be back on the bench in less than six weeks, with ample time to return for the court's February sitting. The primary reason she's currently at home is because her immune system is temporarily vulnerable. It's routine for anyone with compromised immunity to limit public exposure, regardless of their age. I continue to be inspired by RBG's extraordinary perseverance and resilience! With every challenge, no matter how daunting and seemingly insurmountable, she has persisted through, with every fall she has in every way risen. She has prevailed through previous health challenges, with grit and discipline, returning to the gym. When her beloved husband, whom she'd shared the entirety of her adult life with, she took no time off from the bench. It's amazing that this is the first time in her 25 years of service with SCOTUS that she has not been present for oral arguments. Some people don't honor their commitments due to rain......
