I'm pretty sure there is already case law in respect to this, which is why even the military and prisons are required by law to provide kosher meals to observant Jewish people.

Interesting question.

I suppose one could make an argument that a girl in a tux is not intended to be intentionally confronting, while the cow suit is, which may effect the appropriateness of the clothing. I don't know. I look forward to seeing the case law following the first vegetarian who has to file suit when her school cancels the formal rather than let her attend in such a get up.

I don't think the butchered bloodied cow suit would be confrontational but perhaps you are thinking more annoying of other's sensitivies? I don't know if someone's freedom of speech can be denied on the basis of being annoying.

Now if it creates a public nuisance, I could see why discrimination could happen -- let's say for example a future clothing designer wants to make her dress out of 200 yards of fabric. That's fine in itself to create it... however, that would be a nuisance for others as a dress with 200 yards of fabric might take up half the dance floor!

p.s. I didn't know that about Kosher food in regards to military/prisons, but high schools, middle schools and other public schools hardly have anything that resembles "food" in the first place. lol Sad but true.

As far as the case, I didn't think it would win because she filed so late all the while saying that she intended to do this a year ago. So, it was my thinking she didn't give the school enough time. However, I then realized she may not have been able to do anything about it a year ago as she had to wait until she was 18 years of age, but I think the parents could have filed suit on their daughter's behalf a year ago?

I do not disagree with the judge's conclusion, but I think his reasoning leaves a gap open. Yes, it is a gap that only a nudist who really wanted to make a point or some <insert inappropriate word> would actually capitalize, but there are nudist who want nudism to be more accepted, and the world has more than it's fair share of <insert inappropriate word>s.
If the woman chose to wear a gay pride tshirt and jeans to the formal, that would have not been allowed. It is a formal event, and all attending are expected by tradition and protocol, to wear formal wear.
Formal wear being a prom dress or evening gown, and for guys a tux.
The judge ruled that the woman could wear a tux.

Does this also allow a male transexual to wear a prom dress to the prom?
If tastefully done, I sadly have to say, it would. Not the traditional drag queen man dressed in womens clothes.(basically picturing Travolta in a dress) But the male actually trying to look "good" in the dress. I believe the limits would have to be decided in court, Because either way could disrupt the dance. (a man in a dress is not a pretty sight.)

On April 2 Constance and her date went to the scheduled prom at the country club in Fulton Mississippi&#8230;her other classmates went to a separate parent-organized event that was kept secret from Constance and seven other students two of whom have learning difficulties.


"They had the time of their lives," McMillen says. "That's the one good thing that come out of this, (these kids) didn't have to worry about people making fun of them (at their prom)."

In the end it shows that this young lady has got class&#8230;it&#8217;s a pity so few other people in her home town have so little

As it turns out, while Constance was invited to a prom, she wasn't invited to "the prom". Basically, the local community put on two proms and most of the kids were invited to both (or more specifically, the "real" prom) while Constance and a few others were only invited to the fake prom.

From the AP: "The 18-year-old lesbian student said Tuesday she was one of only seven students to show up at a private event chaperoned by school officials last Friday night. She said the rest of her peers went to another private event where she wasn't invited."

It will be interesting to see what comes of this; I'm wondering if some of the people who told the judge that Constance would be welcome at the alternative prom -- causing the judge to rule the school did not need to reinstate prom -- will find those people in contempt of court. If nothing else, I think it says a lot about the community that they would lie in the way they have about this, making Constance think she was going to the same prom everyone else was; I don't think Christ would look favorably on this towns actions.

It's possible that the parents/school/etc honestly intended for the "court ordered"-prom to be a succes, but that some other people + the other students decided to ruin that party by not showing up, in which case you can't really sue the school for not furfilling the things they promised to the court.

But if it was really a case of the organisers of the "court prom" also organizing the "actual prom for cool people", then that's just sad.. and if I were the judge I'd execute those responsible (or give them a fine or something.. Whatever you feel is most appropriate)

In any case, you've still got some sad, sad people over there. Jesus would be proud :/

Hang on &#8212; it's even worse than I thought. Jesus' General has the scoop: the kids at that high school created a Facebook group, "Constance quit yer cryin". Unbelievable. Here are samples of what they wrote there (they're buried now; decent human beings discovered the page and have flooded it with comments supporting McMillen and berating the cowards who played this game*):
Mitchell Henderson: lulz rug munchers are hilarious. Come join me in hell, there's ipods all around for dance parties. As long as you bring someone to scissor with.
Melody Carol: JAlthough, she asked and they said no, she should have just [wash my mouth][wash my mouth][wash my mouth][wash my mouth] and dealt with it. The school did not need to cancel the prom to shift attention from here. That's just gay.
Brittany Kay Brown: jeremy, that's your fault for not coming out of the closet. IAHS is not a bigoted school. This whole town is based on Christianity.

She was invited to the school prom, the school went to a Parent arranged

This pretty much proves my assumption that the principle did what he did to avoid the fight in the community. The community openly descriminated against these kids(not only homosexaul, but special needs kids.).

I don't see how the judge can fault the school. The school had its prom. The parents arranged the event themselves, thus making it a private affair. The community is despicable, but I don't see any possibility for legal action. (unless the jusge can find some loophole to fine the school.)

The judge said that this couple must be allowed to attend the schools prom. They did. The principle and some teachers chaperoned the event.
The real prom, endorsed and embraced by all "normal" kids, was held elsewhere.
I think the kids should be held responsible too. They had the option of going to the school event, and chose to embrace the descrimination, by going to the "popular" Prom.

I hope this couple sue for the original actions, injury. But I don't see the outcome being challenged.(unless they can prove the school knowingly encouraged the alternate prom.)

That in itself is a really big acheivement. Anyone that has planned a suprise party knows how hard it is to keep it a secret, and when 99% of the school knows and doesn't let it slip?

They(the classmates) either were to afraid to tell, or disliked these kids so much they didn't want to tell. There is a lot of emotion in this action, and none of it seems positive.

Actually, I think you are reading something into the story that isn't there. Both proms were private proms, the school did not sponsor either one (and they may have provided chaperones for both proms -- if the did I suspect that would be actionable). And while I will admit the story can appear confusing, this Jackson, MS station confirms it was a private prom, "Constance McMillen said she was one of only seven students to show up at a private event chaperoned by school officials last Friday night." The school did not have a prom.

My first roommate back in high school wore a prom dress to his Winter Formal, and last I checked, he is a straight guy. Some of the girls tried to work with him and make him look better, but for me, who had up till that semester lived in a conservative family in a conservative part of town, it was a huge 'Your not in Kansas anymore'.




As to the events since... I made a bet with my mom this is what would happen. Now to call her and tell her I won. My mom, even as someone who sees homosexual sex as a sin, thinks she should have been allowed to go to the prom, so she will probably be depressed hearing people went to such lengths to back stab this girl.





Well, this just goes to show that homosexuality is the new black, and that homosexual marriage is going the same route interracial marriage.

the Mississippi Safe Schools Coalition in Tupelo, Miss will be holding a second chance prom for all Mississippi students. Upon learning of McMillen's "fake-prom" ordeal, the Grammy-winning band Green Day, the singer/performer Lance Bass, and numerous other celebrities.

Unlike the fake prom put on by the parents in Fulton All Mississippi youth are invited, including students from McMillen's high school.
