Dershowitz is flat out wrong here. The complaints in the Congressional subpoena cases stated that Congress was attempting to carry out an "improper criminal procedure" and that the records were not necessary for carrying out legislation. The minority dissent (by a Trump-appointed judge, no less) in the Trump v. Mazar's ruling stated that Congress could only investigate allegations of presidential criminal behavior as part of an impeachment inquiry.

The other case pertained to the rights of state and local courts to subpoena the President.

Seeing as this is related to impeachment - which one Trump appointee explicitly stated would authorize the contested subpoenas - and not a legislative or criminal inquiry, and Congress is not a state or local court, I don't see how a ruling on these cases would apply to the current situation.

That is irrelevant to what we're discussing. Congress is not a state or local court.

No, the purpose of executive privilege is to protect the function of the government. If the Executive Branch can assert executive privilege any time Congress asks for information in pursuit of its oversight duties, then Congress cannot perform those duties and the branches are not co-equal anymore.

McConnell's statements, both in the OP and when he stated that there was "no chance" Trump would be removed, demonstrate that he cannot be considered an impartial juror. The idea that the lead juror would be coordinating with the Defense - and openly at that - is a complete travesty of justice, no matter who you're talking about.

If we follow the line of people who can be considered an impartial juror, how many Democratic Senators will have to recuse themselves?

All the ones running for President certainly
Then any other who have spoken of the President as guilty as a forgone conclusion.

Are there any Democratic Senators left?
