Anti-smoking laws do vary by state. Around here, you can smoke anywhere except public buildings such as schools, restaurants, government buildings and such. You can smoke in your home, in your car, outside most paces and our hotels still have smoking rooms. I also believe that it is available in a pill form.
The thing is, it is illegal in many places right now, but it is permissible in several states for medical purposes and there are states looking at legalizing it right now. So, if states legalize it, would it be okay for God's people to use it?
