Because even in cases like that, mothers are STILL generally awarded partial custody.

However, her kids were older and Wonkette article expresses that she willingly gave him custody and, in her words, "while she had been a good mother, it's not a good time for me right now".

THAT I do find selfish. Once you're a parent, you shouldn't be picking and choosing when it's a good time for you to be a parent. And if she can't be a parent to her own kids, why in God's green earth would I want her running anything, let alone a state?
If she can't take care of her own children, how can she take care of an entire state?

When she traveled to work, she left no children at home. When she returned, there were no children waiting for her. That's because she lost custody of her children, they were in the care of someone else. :wave:

No in the divorce settlement she and her soon to be ex decided the children would live with their father. Pretty simple.

No in the divorce settlement she and her soon to be ex decided the children would live with their father. Pretty simple.

You are saying then that she decided she did not want primary custody of her kids and chose to have the step father have primary custody voluntarily. Would that be correct?

They didn't have a prenup so yes it was their money.
You don't need a prenuptial agreement. Assets you own prior to marriage are not community property unless said assets are comingled. A 401K would be an asset that was not comingled.

Very much correct. He would have had to have put her name on his 401K after marriage for it to be 1/2 hers. Any savings or stocks he had before the marriage would also fall under the same guidelines.

If he indeed to cash in a 401K to pay for her school, he was a heck of a nice dude.

That depends on the state. In TX it isn't so cut and dry. I know one woman who indeed did get a part of her husbands 401k as part of the divorce right here in TX. So that isn't the case here. Here in TX inherited property and lottery winnings don't commingle if one doesn't want them to.

It is however irrelevant as he made the decision all on his own, and he got paid back.

Likely the same for Wendy.

However it doesn't really matter. They were married when she went to law school so it was their money, and they spent it together.
