The investigation of Adams started three years ago during the Biden admin and as far as I can see has nothing to do with Trump or immigrants.

Paul Clement, a former U.S. solicitor general, will examine the Justice Department’s decision to dismiss the bribery case against New York’s mayor.

U.S. District Judge Dale E. Ho on Friday chose Paul Clement, a U.S. solicitor general under President George W. Bush who has typically represented conservative political causes in court, to advise him on the matter.

Ho noted that “there has been no adversarial testing” of the government’s motion to abandon the Adams prosecution — a controversial decision that prompted at least eight federal prosecutors to resign in protest.

The judge asked Clement to answer questions such as whether the legal standard for dismissal had been met and whether, if its request is granted, the Justice Department should be allowed to reinstate charges against Adams if it chooses. Ho also indefinitely postponed the scheduled April date for Adams’s trial, asking Clement to deliver his briefs by March 7 and scheduling additional arguments “if necessary” for March 14.

Apparently, Clement has opined that if the government doesn't want to try him, there isn't really a way forward to do so. [IANAL, but I don't see why independent counsel can't come in, although obviously it must be hard to try to pick up somebody else's case.]

So Clement says it should be dropped, BUT he also says it should be dismissed with prejudice so it cannot be refiled at a later date. He specifically calls out the optics of the feds having something hanging over the mayor to use as leverage.

Judge makes the final call.

Dismissed with prejudice would be fine.

3 federal prosecutors assigned to Eric Adams case resign, say they won't admit to 'wrongdoing'

"The Department placed each of us on administrative leave ostensibly to review our, and the Southern District of New York U.S. Attorney’s Office’s, handling of the Adams case," the trio of prosecutors assigned to Adams' case, Celia V. Cohen, Andrew Rohrbach and Derek Wikstrom, wrote to Blanche. "It is now clear that one of the preconditions you have placed on our returning to the Office is that we must express regret and admit some wrongdoing by the Office in connection with the refusal to move to dismiss the case. We will not confess wrongdoing when there was none."

"We have served under Presidents of both parties, advancing their priorities while pursuing justice without fear or favor," the three prosecutors wrote. "The role of a career prosecutor is not to set policy. But a prosecutor must abide by the oath to uphold the Constitution and laws of the United States and the rules of professional ethics set by the bar and the courts."

They later added, "Now, the Department has decided that obedience supersedes all else, requiring us to abdicate our legal and ethical obligations in favor of directions from Washington. That is wrong."

Trump is weaponizing the DOJ.
