Strictly speaking all who are lost - are lost under the Old Covenant "Obey and live" - for there is no one sinless. All have sinned.

And all who have ever been saved from Adam to this very day - were saved under the New Covenant for there has only been "one Gospel" in all of time Gal 1:6-11 and "the Gospel was preached to Abraham" Gal 3:7.

Why would they be required to keep the law, and wouldnt that make the new hidden covenant ineffective, if they (some)
Were unwitting benefactors from it?

Absolutely not!

It comes down to - can God unilaterally end a Covenant because He made a better one to replace it?

The two covenants are not dispensations. All who do not have Christ are under the law, which is "obey & live, disobey & die".

And, I might add, are falling short of God's love. So everyone has sinned and continues to fall short of God's agape love even through they are growing in grace.

So yes, you are right. The lost are under the law. The law itself is not the old covenant. It's the terms of the law (obey & live, disobey & die) that makes it the old covenant.

Gal 3:21-22

Is the law then contrary to the promises of God? Certainly not! For if a law had been given that could give life, then righteousness would indeed be by the law. But the Scripture imprisoned everything under sin, so that the promise by faith in Jesus Christ might be given to those who believe.
