In 20-30 years I can imagine there being a case for this, but I can't say it will happen. There is a growing dissatisfaction with neodarwinian theory to explain what is the case, and a growing demand to postulate new factors to explain them. Science has already crossed the plateau of what is to be explained but now it has reached the cliff of consciousness with acute rationality and it's easy to see a demand for new scientific vehicles to travere this terrain. I think as the "old guard" dies out we might start to see some approaches made that have some similarity to religion. The westernized world also seems to be shifting toward "no religion" with supernaturalism which might steer the ship in very new directions.

2. The Earth was created with embedded age, not embedded history. Embedded age is maturity without history. Embedded history is Omphalos.

Were there mountains and river valleys? Sand? Soil or mud?

The First Amendment to the Constitution of the United States includes the Establishment Clause which prohibits the establishment of religion on behalf of the government. This clause has been used in cases against the teaching of creationism and ID in the past, including the Edwards v. Aguillard and Kitzmiller v. Dove Area School District trials respectively.

If creationists in the U.S. truly believe that evolution is a religious belief, surely they would be able to prove such in a court of law and have it stricken from the education system?

Modern creationist organizations currently take in millions in donations annually, so funding such a lawsuit would not be prohibitive.

Why aren't creationists willing to take the challenge to the courts?
What does Scripture say about taking things to court before unrighteous judges ?

(it says don't)
