Help!!

My stbx has paid health benfits since were are separated right now am I entitled to the health insurance since Iam still his wife?? He's suppose to get it in a few days, so he says. I cant get ahold of him. But I was just wondering if anyone knew if iam "legally" entitled to it. I need to see a doctor SOON for personal reasons. Its not like he is paying for it himself.

My stbx recently threatened to cancel health insurance on me AND our kids. It is fully within his power to do that since it's through his work. Fortunately it was just a threat and he didn't do it. That could have been very expensive (for him when I got him to pay) as I will not hesitate to take the kids to the dr. or dentist if I think they need it - with or without insurance!

I hope yours doesn't pull what mine threatened to. You could probably sue him to pay your medical bills later, but that doesn't help when deciding whether to make an appt. God bless.

You're not legally entitled to it if it is through his health insurance policy through his work. Unless you have a legal separation agreement that specifies that he will pay for and/or provide health insurance, you're not entitled to it just by being his legal wife.

Honey I feel for you!

Right after I left my husband he droped me from the health insurance and there was nothing I could do to stop it. We were still kind of going back and forth a little bit on whether we were going to try to work it out (again) or not. He kept saying, "I love you! I don't want to loose my family." Then in the same same few days he removed me from the inusrance, just in time for me to find out he had given me an STD, and he was so smug and "in your face" about it. It was purely for spite because it was not costing him a single extra penny to keep me on his insurance because he has the option between single or family plan. He had to keep the familiy plan for the kids covereage, and the price is the same whether it's one family member or multiple family members.

I'm currently looking into some private insurance or medical share plan of some sort.

I believe in some cases the court can order it and if he removes you, it can be considered abandonment... I also think you are eligible for COBRA coverage:


Qualifying Events for Spouses:

• Voluntary or involuntary termination of the covered employee's employment for any reason other than gross misconduct
• Reduction in the hours worked by the covered employee
• Covered employee's becoming entitled to Medicare
• Divorce or legal separation of the covered employee
• Death of the covered employee

It was not costing me anymore to keep my ex on the plan (although she moved out of the area so she couldn't get services anyway) but just on general principle I kept her on mine until the divorce was finalized.
