(CNN)FBI Director James Comey said Friday the bureau is reviewing new emails related to Hillary Clinton's time as secretary of state, according to a letter sent to eight congressional committee chairmen, a surprise development with 11 days until the election.

After recommending this year that the Department of Justice not press charges against the Secretary of State, Comey said in the letter that "recent developments" urged him to take another look.
"In connection with an unrelated case, the FBI has learned of the existence of emails that appear pertinent to the investigation," Comey wrote the chairmen. "I am writing to inform you that the investigative team briefed me on this yesterday, and I agreed that the FBI should take appropriate investigative steps designed to allow investigators to review these emails to determine whether they contain classified information, as well as to assess their importance to our investigation."

If, hypothetically speaking, she won the election but ended up in prison because of this, what would that mean in practice?

Would she serve as the president until the sentencing, or some other specified point, and then hand the job to the vice president? Or is the US law that simple for elected officials? At which point she would lose the right to act as a president if found criminally guilty?

I would be like the Watergate fiasco. Yes, there would be hearings then impeachment hearings, and impeachment vote and if impeached by the House, the charges would be preferred to the Senate for trial. It takes a super majority in the Senate (2/3rds) to convict. Nixon on the urging of allies resigned to avoid impeachment.

But for some reason she has been leading in the polls all this time even though hardly anybody goes to see her speak, go figure...

I don't understand how she is even running since she should not have security clearances. Go figure.
I don't recall having security clearance as one of the constitutional requirements for the job.

I'm sure Hoover would have approved of such a situation, though...

I must have missed the constitutional amendment that said presidential candidates need a security clearance.

That slope is quite slippery.

The allegations came to light after she left the state dept. So they could not revoke the clearance then. However, even after the allegations came to light the State Dept could have requested her security clearance be suspended pending an investigation.

NOW if she is elected President, regardless of previous security violations she gets top clearances and access based on the job.

As a presidential candidate she is getting daily top secret level briefings. So we know she still has a clearance.

I'm retired Army and given my job on active duty for over 26 years maintained a TS clearance. If I elaborated anymore I would be really pushing it. That's how we are trained.

I continue to do work for the military so maintain my clearance. Every six months my company and the military requires me to conduct security training. If you take the basic course which everyone must, you wonder how these politicians avoid jail.

Frequently I see retired generals and politicians who say too much on the news programs. We really need to enforce the "need to know" more often which would help reduce these violations.

Need to know means you can have one of the top security clearances, but if you truly do not need to know the info, you don't get access.

However as President one can invoke need to know given the job. That is concerning given both candidates.

The President needs access to a TS SCI clearance. How else would they get their daily DoD and intelligence community briefings?

That restriction doesn't prevent anyone becoming president. The constitutional requirements are clear.

Or do civil servants have a veto over the people's will in the USA?
