Just, you do realize that what makes a tree is not its height, right? If that were what made the determination, a lot of ornamental trees would not be trees.

What was perceived as a tree during Jesus' time is different than the biological classification is now. However, Jesus should have seen this objection coming.

I sincerely doubt that. Now you have to show that they did not have a word for "bush" and since there is a tale of a "burning bush" in he Bible I don't think that you will be successful.
