Because Monday was the deadline for all 15 Arizona counties to certify their results, Cochise’s action could put at risk the votes of some 47,000 county residents and could inject chaos into the election if those votes go uncounted.

In Pennsylvania, where counties also faced a Monday deadline to certify their general election balloting, local officials have faced an onslaught of petitions demanding recounts. And officials in Luzerne County, in northeastern Pennsylvania, deadlocked Monday on whether to certify the results, according to multiple media reports. Election officials there did not respond to inquiries from CNN on Monday afternoon.

Maricopa County Superior Court Judge Randall Warner on Tuesday dismissed a lawsuit filed by Republican attorney general candidate Abe Hamadeh contesting the results of the Nov. 8 election, finding that the complaint was premature.

While dismissed for now, Hamadeh still could file a complaint later, after the expected statewide certification of the election.

"The merits of the lawsuit still stand. We will re-file the case after the statewide canvass," said Hamadeh, who was joined in the complaint by the Republican National Committee.

Dan Barr, attorney for Democrat Kris Mayes, commented after the complaint was dismissed: "Their major problem is they still don't have any facts to support their lawsuit."

Former Arizona Attorney General Terry Goddard and former Maricopa County Attorney Rick Romley on Tuesday urged prosecutors to consider criminal charges against the Cochise County supervisors who refused to certify the county's election Monday.

Supervisors Tom Crosby and Peggy Judd have repeatedly questioned election procedures and also been warned that if they did not canvass their election Monday, the state deadline, they not only could disenfranchise voters in southeastern Arizona but also face criminal penalties.

The supervisors already are facing two civil cases, both seeking to force them to certify the election this week so the statewide canvass can include Cochise County votes Monday.

"Their votes against certification resulted in the three-member Board failing to perform its legal duty to certify the election," said the letter from Goddard, a Democrat, and Romley, a Republican.

They added that they "take no pleasure in making this prosecution recommendation," which was sent to Arizona Attorney General Mark Brnovich and Cochise County Attorney Brian McIntyre.

"But we believe deeply that the rule of law dictates that public officials be held accountable when they refuse to comply with their legal obligations — all the more so where those officials’ actions threaten to undo the proper administration and integrity of elections, disenfranchise thousands of voters, and potentially even alter the results of some races," they wrote.

The notion "play stupid games, win stupid prizes" comes to mind.

For my fellow US citizens who happen to live in Cochise County, Arizona, I would like the board to get less stupid and just comply with the law, but part of me thinks that this fever won't break until at least one county goes through with the stupid action and manages to get all votes from their county voided (by not certifying them). So let's think about the consequences:

1. Offices elected in concert with Arizonans inside and outside Cochise County are now elected by only those outside.

If I understand correctly, removing the Cochise County votes would flip a minor statewide race and a US House seat from R to D. Oops.

2. Offices elected only from within Cochise County would have 0 votes for anyone and new elections would have to be held.

I'm not sure if there are any such offices, since I haven't heard about this as a "consequence", and I don't know what was on the Arizona ballot. These could include city offices, county offices (I suspect the County Board wasn't on the ballot or they would not be so cavalier with their own reelections.), or state legislative offices.

Do not expect the voters to be forgiving if the board manages to disenfranchise them. A total wipe out of the Board at the next election would be expected.

On Wednesday, they were caught flat-footed when Blehm declined the offer, as did another attorney he had recommended.

I must admit being puzzled by that. I can see someone who is front wanting to claim victory, but I can't understand someone in arrears by just 550 votes conceding defeat with a recount to come.

It's democratic because the laws are passed by elected officials voted on by the public.
