The Department of Justice has reached an agreement in principle to settle a lawsuit brought by the family of Ashli Babbitt, a pro-Trump rioter who was shot by a U.S. Capitol Police officer during the Jan. 6 Capitol riot.

The details of the proposed settlement were not made clear during a Friday hearing before federal Judge Ana Reyes, of the U.S. District Court for the District of Columbia.

Babbitt's family members sued the government in January 2024 seeking $30 million for what they allege was her wrongful shooting death by Capitol Police Officer Michael Byrd.

Byrd was cleared of any wrongdoing following an internal investigation into the actions leading up to his shooting of Babbitt as she tried to climb through a broken window that led to the House Speaker's Lobby, where several lawmakers and their staff were sheltering from rioters.

Babbitt's attorneys disclosed the agreement in principle was reached during the hearing, which was convened on an emergency basis after one of Babbitt's prior attorneys sought a preliminary injunction on Friday to ensure he received payment for his work on the case if a settlement was formally announced.

Robert Sticht, the lawyer for Babbitt's family, said he expected the family to sign the formal settlement agreement within the next three weeks.

President Donald Trump has repeatedly expressed his solidarity with Babbitt's family and called for "justice" for what he has said was her "murder" at Byrd's hands -- in line with his broader vocal support for the pro-Trump rioters who attacked the Capitol to overturn his 2020 election loss.

In March, Trump said in an interview with Newsmax he wasn't aware of the lawsuit brought by Babbitt's family but promised he would "look into" it.

If the case had gone to trial, Babbitt's family would have surely lost because she was killed in the commission of a deadly crime and the policeman defending our Capitol was acquitted.
Not only is the DOJ throwing away our taxes, they are encouraging the most lunatic of the Trump fringe to break the law again and make false claims of brutality.
As a mother I sympathize with Babbitt's mother. She raised a criminal and may be feeling some guilt--which our tax dollars will more than compensate for.

What are you talking about? The OP and @Fantine's response are about Ashley Babbitt. I've watched the video of her shooting at least a dozen times. She was part of a crowd that broke through windows of barricaded doors and was shot while climbing through one of those broken windows. People in her group shouted "gun" before she was shot. She was a terrorist and she knew what she was doing.

No, I watched the video that was shot by people within the crowd of insurrectionists.

Maga types have their own who they feel sympathy for. Leftists have their own they feel sympathy for. Both hate their enemies and im simply pointing it out. Fantine and other leftists like to pretend they love their enemies but they don't.

OK. Officer Byrd was never charged because investigations by the DOJ and the Capitol Police showed that the officer had acted lawfully. Babbitt was also shot in the shoulder--if she hadn't been jumping through windows a shoulder injury would not have killed her. If there is not enough evidence to indict, that is the same as an acquittal. As Fact Check showed, Officer Byrd was not "pardoned" by Biden. There was no evidence to indict. Trump, on the other hand, pardoned 1598 insurrectionists/criminals.

From Fact Check:
In an August 2021 interview with NBC News, Byrd described his actions during the Jan. 6 attack. He was an officer in charge of defending the House of Representatives chamber, where 60 to 80 representatives were taking cover. When rioters broke through the glass door outside the Speaker’s Lobby, which leads to the House chamber, Babbitt attempted to climb through the door before Byrd shot her in the shoulder. Babbitt, a Trump supporter, died from her injuries.

In April 2021, the Department of Justice said it would not pursue criminal charges against Byrd and closed its investigation into Babbitt’s death. The DOJ said, “Specifically, the investigation revealed no evidence to establish that, at the time the officer fired a single shot at Ms. Babbitt, the officer did not reasonably believe that it was necessary to do so in self-defense or in defense of the Members of Congress and others evacuating the House Chamber.”
