Pardon my intrusion, but when two atheists go to a Government office, get a Government issued Marriage License and get married by a Government Justice of the Peace, I would refer to that as a Secular Marriage.

What would you call it?

If they're members of the opposite sex, marriage.

Because minors cannot give consent. The age of majority does vary depending on the jurisdiction.

Dogs and cats also cannot give consent.

None of this has anythjing to do with the topic at hand. This woman was held in contempt for refusing to follow a court order to issue marriage licenses, which is a duty of her office.

My cat gets all huffy if I try to kiss her little ears. I'm sure I'll never get her to agree to marry me. :(

Glad to see us angling back towards the real issue here. There is no reason for her to have been jailed indefinitely. The abuse of judicial power--quite apart from the right of the courts to rule on the legality of gay marriages--is something that should concern even the folks making the snarky comments and the "she got what she deserved" posts. The minute it happens to someone THEY favor, you'll be hearing another tune played.

If they let her go, will she simply halt the issuing of marriage licenses again? What's to stop her? What other recourse do the courts have if an elected office holder continues to defy a court order?

So let's not make the artificial distinction, and agree that marriage is marriage no matter who performs the ceremony.

Since the licenses in question are coming from the State of Kentucky, they get to set the rules... within reason, of course.

Maybe you'd find some other ridiculous sequence of events to be "all she has to do." Like...

All she has to do is have sex with the sheriff.

or

All she has to do is publicly renounce her faith in Christ.

or

All she has to do is agree to give up her citizenship.


Do you really, really not understand the issue here?

Interestingly, none of these things would actually get her out of jail.

Marriage is not a secular institution. "Secular marriage" doesn't exist.

How about this: If her religious convictions prevent her from doing the job she was elected to do, she can resign.
