Justice from God must come with God being judge. Christ bore penalty from that for those with repentant faith who come to him, that they turn from known sinning to be in Christ, that they come to God in the needed way restored. Those that do not repent to do this are still subject to that just. If they do not exist after dying, there would not be that justice. Some more worthy of penalty from God lived very comfortably through there life here at the expense of others. But souls do continue, I do not call that immortality or even eternal life, they are then subject to the fair justice from God to all that they never repent from. This would not be torture but they will be in misery for the things they never repent from. Bodies of the dead that are raised with the souls restored are subject to that and that second death is separate existence from the life the redeemed will have, in bliss in God's presence continually after that.
