It's not that it's old. It just a statement like that from the president is so frequent, it becomes elevator music.
I may have to stock up on more pearls to clutch and send them out as Christmas presents.

Yes. Threatening to kill the president is treasonous.

I don't agree with what he said, and I think he was stupid to do so, but the president is not the United States. Threatening to kill the president is not treason, it is a felony. Treason specifically involves levying war against the United States or aiding its enemies.

I dont think calling up the national guard to provide security for a federal building and for crowd control counts as treason, but if their presence can prevent ICE from gassing neighborhoods because there is a witness with authority also, I'm all for it.

Jefferson Davis probably would have been prosecuted if not for the fact that Andrew Johnson issued a massive pardon for treason to everyone who was involved in the rebellion, which obviously includes Davis ("I, Andrew Johnson President of the United States, by virtue of the power and authority in me vested by the Constitution and in the name of the sovereign people of the United States, do hereby proclaim and declare unconditionally and without reservation, to all and to every person who, directly or indirectly, participated in the late insurrection or rebellion a full pardon and amnesty for the offense of treason against the United States or of adhering to their enemies during the late civil war"). What was the United States going to do to Davis after that?

The elephant in the room was the very real possibility that a trial would result in secession being ruled legal. The Confederate States followed a model of secession that had been accepted at the time: See William Rawle's A View of the Constitution of the United States of America. Rawle served as the District Attorney of the Philadelphia Federal District at the appointment of George Washington and who had been involved in prosecuting those involved in the Whiskey Rebellion. Rawle was of the opinion that secession was unwise, but did suggest a legal framework by which it could be done. So when Union calvary captured Davis near Irwinville, Georgia, though the Confederacy had lost by force of arms, the legal issue was something the victorious Union wasn't particularly keen to delve into. After spending about 300,000 Union lives to prevent secession, the last thing the Union wanted was the courts to say "You can call go home now; the Confederacy legally left the US."

The USSC would later rule, in a case involving Texas, IIRC, that secession as conducted by the Confederate states was illegal, but that had yet to happen. When Davis was captured and held prisoner, the legality of secession was an open question.

Please stop saying "the Union", it is "the United States".

No theory of secession is needed, Davis, Lee, etc. all "made war against the United States" the core definition of treason given in the Constitution.
