"What America First Legal has uncovered after months of investigative work paints an unfortunate picture of the rule of law in Washington. A former President of the United States — the most democratically accountable officer under our Constitution — was subject to a politicized referral concocted by the Biden White House that led to an armed FBI raid of his home — where his wife and youngest child live — and is now subject to prosecution," America First Legal Vice President Dan Epstein said.

We are looking more and more like a banana republic.

Wow, even if this is true, it is dumb.

Since OP has not linked the actual article, it is here.

I will save you the loss of braincells. Here's the crux:

This revelation cuts a knife through the entire indictment as it proves that many, if not all, of the documents President Trump is accused of unlawfully retaining were and are currently still retained by the Executive Branch and stored on DOD servers.

Supposing there is a copy of these documents on DoD servers does not make the boxes of illegally retained physical documents vanish from Mar a Lago.

But everybody knows that a classified document can only exist in one place at a time!

No, in this case, it's just you. This "scandal" was just silly. I know you want Biden/Obama/Democrats to look as bad as possible all the time, but at least try to put up something legitimate.

No wonder they had to go to litigation in order to obtain the documents. It just gets worse and worse for the Biden administration.

Are you new to FOIA?
A “watchdog” organization asks for documents and the government says “no”.
Then the watchdog organization files a lawsuit to compel the government to give up the goods, (and broadcasts this normal, everyday, pedestrian civil suit like they’re defending the republic one case at a time!!! Please send money to help!)

Another instance of “normal” being portrayed as something sinister and “crooked”, (somehow).

It’s pathetic, it really is.

The government has to have a legitimate legal reason to withhold the records. The organization has to take it to federal court, where half of the judges or so might toss the case just because they don't want to buck the federal government. The government has essentially limitless money (taxpayer dollars) to defend and delay.

It's like some people think that there's someone writing out these documents on parchment with a quill pen.

The Biden White House made a "special access" request to get the documents at Mar-a-lago. The record request was supposed to be a request “that is needed for the conduct of current business of the incumbent President’s office." So it is even more outrageous and more evidently illegal when documents were already in the possession of the government.

Yeah, you are not allowed to have a hard copy document of information that is required 'for the conduct of current business of the incumbent President’s office'.

And hey, if you want to make a claim that uses quoted information then you be sure to link to the source so we can check the veracity of the claim, its source and its context. Are we clear on that?

I left out the "and that is not otherwise available." But in any case it wasn't for Joe's current business, it was to go after his political opponent:

§ 2205. Exceptions to restricted access

Notwithstanding any restrictions on access imposed pursuant to sections 2204 and 2208--

(1) the Archivist and persons employed by the National Archives and Records Administration who are engaged in the performance of normal archival work shall be permitted access to Presidential records in the custody of the Archivist;

(2) subject to any rights, defenses, or privileges which the United States or any agency or person may invoke, Presidential records shall be made available--

(A) pursuant to subpoena or other judicial process issued by a court of competent jurisdiction for the purposes of any civil or criminal investigation or proceeding;

(B) to an incumbent President if such records contain information that is needed for the conduct of current business of the incumbent President’s office and that is not otherwise available; and

(C) to either House of Congress, or, to the extent of matter within its jurisdiction, to any committee or subcommittee thereof if such records contain information that is needed for the conduct of its business and that is not otherwise available; and

(3) the Presidential records of a former President shall be available to such former President or the former President’s designated representative.

And what would your reaction be if every ask for documents was met with an “Okay, here you go!” ?
The government always says no, unless it is in the best interests of the government to release the documents ASAP. That’s by design.

So the “complaint” is that the system works as it is designed to work.
Weak sauce.
