Lauren Handy and others are standing trial for blocking access to an abortion clinic in DC. Jury selection has been difficult. Not just because abortion is a hot-button issue, but because people in DC remember the woman who had 5 fetuses in her home (although that is not part of this case).

The daunting task of finding an impartial jury in an abortion trial​

The trial, which is expected to last three weeks in U.S. District Court in Washington, will center on access to abortion and whether those on trial violated the Freedom of Access to Clinic Entrances Act, a 1994 law that prohibits threats to and obstruction of a person seeking reproductive health services or providers.

Jury selection has also been further complicated after the lead defendant made news last year for obtaining fetuses from the driver of a medical waste disposal truck in D.C. — an account the waste company denied — and storing them in a Capitol Hill rowhome.

Congress passed the FACE act as a reaction to increasing blockades at health clinics providing abortion, as well as violence toward those clinics, providers and patients. In 1993, David Gunn was fatally shot outside his Florida abortion clinic in what was believed to be the first time in the nation that an abortion provider was killed in protest. [I would point out that murder is not a protest.]

The trial for a second group of defendants facing charges from the same blockade is scheduled to begin next week.

Based on the convictions, she ordered Handy and the other co-defendants jailed until sentencing later this year. The defendants face up to 11 years in prison and a fine of up to $350,000.

You can have a memorial service without violating the law. Mishandling human remains or medical waste is a violation of the law.

Medical waste and human tissues are usually incinerated, not thrown in a dumpster.

Atheist, nonbinary pro-life activist sentenced to federal prison for FACE Act violation​

The first pro-life atheist indicted under the Freedom of Access to Clinic Entrances Act has been sentenced to 27 months in federal prison for participating in the 2020 blockade of a Washington, D.C., abortion facility.

U.S. District Judge Colleen Kollar-Kotelly announced the sentence for nonbinary pro-life activist Herb (Rosemary) Geraghty on Wednesday.

On Tuesday, the federal judge sentenced three of Geraghty’s fellow activists — Lauren Handy [she of the fetuses], John Hinshaw and William Goodman — who also participated in the October 2020 blockade of the Washington Surgi-Clinic. Handy is a member of Progressive Anti-Abortion Uprising, another pro-life group of which Geraghty is also a part.

[Judge] Kollar-Kotelly sentenced Handy to 57 months in federal prison for participating in and planning the blockade at the Washington Surgi-Clinic. Hinshaw received a sentence of 21 months incarceration, while Goodman was sentenced to 27 months.
