In a three-page declaration, a top White House personnel official revealed that Musk’s title is “senior adviser to the president,” a role in which he has “no actual or formal authority to make government decisions himself.”

That explanation, provided to a federal court by Joshua Fisher, the director of the White House’s Office of Administration, seems to directly contradict the way President Donald Trump and Musk have spoken publicly about the so-called Department of Government Efficiency, widely seen as a Musk-driven project to shrink and dismantle key aspects of the federal government.

Fisher did not indicate who the administrator actually is.

The technical designation does not mean Musk is not, for all practical purposes, the key decision-maker for DOGE, which has been staffed full of his allies and may still ultimately be fueled by his influence in the White House. [But there are questions about accountability.]

The conflicting stances put the Trump administration in a bind, legal experts say. If DOGE is a federal agency, it can’t shield its records from the public. If it’s not an agency, then DOGE’s tens of millions of dollars in funding weren’t legally allocated and should be returned, some contend.

“The administration can’t have it both ways,” said Adam Grogg, a former deputy general counsel at OMB and now the legal director at Governing for Impact, a left-of-center think tank. “Either it’s an agency covered by FOIA with the authority to do what it’s doing, or it’s purely advising the president and can’t be directing agencies in the way it now is [and spending taxpayer money].”

Recording reveals new details on controversial DOGE employee​

Less than three years before Elon Musk tapped him to take part in a sweeping overhaul of the US government, Edward Coristine, then 17, was the subject of a heated dispute between two executives at the Arizona-based cybersecurity firm where he was an intern.

At issue was whether to allow Coristine to keep his job even though he was suspected of leaking proprietary information to a competitor.

“You’re willing to risk our entire network to a 17-year-old?” one frustrated executive asked the company’s CEO in 2022. “Are you for real right now?”

[CEO] said he wanted to allow Coristine to continue with his internship, in part, because he didn’t want to make him “an enemy” or have him “running amok” with information he was suspected of taking.

Gleason worked for DOGE’s predecessor agency before joining the firm Russell Street Ventures, founded by another DOGE leader, Brad Smith.

Gleason’s appointment is unlikely to change any perception that Musk is in charge of DOGE, but it answers a key question as to its organizational structure.

The disclosure comes just days after the director of the White House Office of Administration sparked confusion by declaring in a court filingthat Musk, the special government employee whom President Donald Trump said in November would lead the cost-cutting group, has “no actual or formal authority” over government decisions. Judge Orders DOGE to Release Records, Citing ‘Unusual Secrecy’ and ‘Unprecedented’ Level of Authority​

In a 37-page ruling on Monday, US District Judge Christopher Cooper instructed DOGE to release information in response to three Freedom of Information Act (FOIA) requests from a nonprofit. The requests were aimed at uncovering more about the agency’s role in “leading the mass firings and major disruptions to federal programs.”

On Monday, CREW’s executive director, Donald Sherman, expressed gratitude for the ruling, saying, “Now more than ever, Americans deserve transparency in their government. Despite efforts and claims to the contrary, the government cannot hide the actions of the US DOGE Service.”
